(Refer to Attachment 2) We have also deleted the future water conveyarcce+i r R e sou R c E s, i i c <br />pipelines from the reclamation plan map (Refer to Attachment 3). <br />Please note, that the annexation will not be officially complete until the effective date of the <br />annexation ordinance. This will likely be at least 30 days after the second reading, which is <br />scheduled for Wednesday, April 13, 2005. Until the annexation is effective, WCR 6 % and <br />WCR 8 will be owned by Weld County. We have notified Weld County that the proposed <br />conveyor crossings have been included within the permit boundary (via phone conversations <br />with Don Carroll and a certified mailing to Public Works Department Engineer Manager Keith <br />Meyer) and that they have the right to comment on this proposal. (Please refer to <br />Attachment 4) <br />Per our conversation, we request that you add the following permit condition: If WCR 6 Y< <br />and WCR 8 are not annexed into the City of Fort Lupton, the applicant shall obtain the legal <br />right to enter (or, in this case cross) the roadways a notarized consent form indicating that <br />SW TKO has the right to install the conveyor crossings from Weld County prior to installing <br />these crossings. <br />3. Related to the question noted above, in the groundwater mode! prepared by Civil Resources, <br />LLC, a number of mitigation measures are proposed to reduce the extent of groundwater <br />drawdown due to mining. Please be aware that some of mitigation measures (including <br />construction of recharge ponds and facflitfes necessary to construct injection dewatering <br />wells) will need to be included in the permit area. Please revise the permit area in all of the <br />exhibits to incorporate these areas. Jn addition, owners of record will need to be notified and <br />an additional 20-days must be allowed for public comment. <br />We will forward the additional legal descriptions of the properties to be included within the <br />permit boundary in the near future. Please refer to Attachment 1 for proof that the owners of <br />record have been notified. We have met with the landowners several times are awaiting <br />signed documents that prove that the applicant has the legal right to enter these properties. <br />4. Rule 6.2.1(2) requires that maps 6e signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. <br />Please resubmit a signed copy of the maps. <br />Please refer to Attachment 3 for signed copies of the maps. <br />S. The exhibits submitted to the Division state, "...mining plan is conceptual and may change <br />due to site conditions." Please be aware that arty changes to fhe proposed operation or maps <br />in the future may need to 6e filed as a revision to fhe permit. Therefore, please remove this <br />language from the relevant exhibits. <br />We have deleted the conceptual note from the plans. (Refer to Attachment 3} <br />
