The Division received comments from the NRCS, the Office of the State Engineer, the=Q)fjt bft E sou R c E s, i r c <br />Fort Lupton, Colorado Department of Transportation (CDO7) and Georgia Landrus regarding <br />the proposed application. The letters are attached. Please address the comments noted in <br />the letters, and make any changes the application as necessary. <br />Please refer to Attachment 6 for copies of our responses to NRCS, the City of Fort Lupton, <br />Colorado Department of Transportation and Georgia Landrus. We have incorporated our <br />responses to the objectors into this letter to you and the application. We are preparing the <br />Temporary Substitute Water Supply Plan and Well Permit application for submittal to the <br />Office of the State Engineer. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Mining Plan Maps <br />7. Per Rule ti.4.3(g), the applicant will need to depict the owner's name, type of structure and <br />location of al! significant, valuable and permanent man-made structures on the area of <br />affected land and within 200 feet of the affected land. Please identify the owners of all <br />structures on and within 200 feet of the affected land. This would include roads, ditches, <br />pipelines, gas lines, gas wells, utility lines, water wells, etc... <br />We are adding the list of owners' names and types of structures to the Existing Conditions <br />Map. We will forward this map to you in the near future. Please note that the location of the <br />significant, valuable and permanent man-made structures on the area of affected land and <br />within 200 feet of the affected land was already on the maps. (Attachment 3) <br />8. Rule 6.4.3(1) requires that all water wells in the surrounding area be identified on the map. The <br />Division could not locate any water wells on the exhibits. Please locate the wells on a map <br />and state the owners of the wells. <br />Please refer to Attachment 3 for a map of the wafer wells in the surrounding area. Per Mr. <br />Schreiner's request, this information is on a separate map. <br />9. The permit boundary surrounds the Robert P. & Dean Villano property in the NE corner of the <br />site. Please state if this area is inside or outside of the proposed permit area, and update the <br />exhibits accordingly. <br />Refer to the Mining and Reclamation Plan Maps (Attachment 3) for the accurate permit <br />boundary. We will forward the revised legal description in the near future. <br />10. The applicant states that the mining face will be nearly vertical to 0.5:1 slope. However, the <br />exhibits depict the mining slopes to be 1:1. Please clarify this discrepancy and revise the <br />text, stabilityanalysis, and maps accordingly. <br />Per our meeting with Allen Sorenson and Erica Crosby on March 17, 2005, the mining face will be 1:1 <br />horizontal to vertical (H:~, as shown on the plans. A note stipulating the maximum encroachment of <br />the mining face toe to the structure of interest (Highway 85, WCR 27, WCR 8, WCR 6 and oil and gas <br />wells will be added to the plans sheet. All text in the permit will be revised to clarify this discrepancy. <br />The stability analysis will be addressed under a separate cover letter. <br />
