For ease of reference <br />we have included your numbered comments in dalics. We wdl forwaM you the Cover Sheet Map <br />(which has the revised permit boundary description), the Existing Conditions Map (which has the <br />structure owners on it), the information regarding the reclamation calculations,lhe legal right to <br />enter for the McCanne Dinh, the legal right to enter the Brancucchi property. and SW TKO's <br />signed comnntment net to remove structures on the prcperty until they owe it. <br />f. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice <br />circulated in the local newspaper, all owners of record of surface lands, easement Iroiders, <br />and owners of record of surface lands that are within 200 feet of the boundary of tha affected <br />land. Drool of notice maybe return receipts of a Certified Mailing or by proof of persona) <br />service. <br />Enclosed please find the receipts for the Certified Mailing to surface owners of record <br />easement holders, and surface owners of record within 200 feet of the aflected land <br />boundary. The receipts have beer. date-stamped by the US Post Office as proof of mailing. <br />(Attachment 1) <br />1. The Division noted two areas that are related to the mining and reclamation plan, but were not <br />included in the permit area. The first area is the conveyor crossing and future reservoir <br />interconnect crossing Weld County Road 6.15 and the other is the future water conveyance <br />pipeline that would cross Highway 85 to the South Platte River. Both of these features are <br />related fo the mining and reclamation plan and will need to be Included in the permit area. <br />Please revise the permit area in all of the exhibits to incorporate these areas. In addition, <br />owners of record will need to be notified and an additional 20-days must be allowed for public <br />comment. The applicant will also need to obtain notarized consent forms between SW 7K0 <br />Joint Venture, LLC and the owner of the property/structures to install such structures. <br />'JVe have revised the permit boundary to mclucfe the future conveyor crossing over Weld <br />County Road (WCR) 6 ,•~ and WCR 8 Attarhed please find the letter that proves that SW- <br />TKOJoint Venture.
