§ 146.71
(b) Prior to the Director's granting approval for
the operation o(a Class 1 hazardous waste injec-
tian well, the owner or operator shall submit and
the Director shall review the (ollowing in(onna-
tion, which shall be included in the completion re-
port:
(I) All available logging and testing program
data on the well;
(?) A demonstration of mechanical intrgnty
pursuant to § 136.68;
(1) Tht anticipaltd maximum pressure and Flow
rare al which the ptrmitlee will operate:
(4) Thr results of the injection zone and confin-
ing zone testing program as required in
¢ 146.70(x)(9):
(5) The actual injection procedure:
(6) The compatibility of injected waste with
Fluids in the injection zone and minerals in both
the injection zone and the confining zone and wish

17) The calculated area of review based on data

(c) Prior to granting approval for the plugging
and abandonment (i.e., closure) of a Class I haz-
ardous wash injection well, the Direnor shall re-
view the in(omration regwred m §§ 136.71(x)(3)
and 146 72(al.
(d) Any permit ISSaed for a Class 1 hazardous
wash injection well far disposal on the premises
where the wash is generated shall contain a cer-
uficalion by the owner or opemtor that:
(I) Tht gtntrator of the hazardous waste has a
program to redact the volume or quantity and tox-
icuy of such waste to the degree dnermined by
the gtntrator to bt economically pracicable; and
Q) Injection of the waste is Ihal practicable
method of disposal eunemly available to the gen-
erator which minim¢es the present and foram
Ihreal to human health and the tnvironnttnl.
§ 146.71 Closure.
(a) Closure Plan. The owner or operator of a
Class I hazardous waste injection well shall pre-
pare, minntam, and comply with a plan (or closure
of the well that meets the regwrcments of para-
graph (d) of this sexton and is acceptable to the
Direnor. The obligation to implenent [ht closure
plan survives the termination of a permit or the
cessation of injection aaivities. The requiremem to
maintain and implement an approved plan is di-
rectly enforceable regardless of whrther the re-
gwrcmrm is a condition o(the pemrit.
(U The ownu or operator shall submit the plan
as a pan of the pernut application and, upon ap-
proval by the Direnor, such plan shall be a condi-
tion of any permit issued.
(2) The owner or opemtor shall submit any pro-
posed significant revision to the method of closure
re0ened in the plan (or approval by the Direnor
no later than the dine on which notice of closure
a required to he submitted to the Director under
paragraph (b) of this section.
(3) The plan shall assure finanual responsibility
as required in § 134 5?(a)(7).
(4) The plan shall include the (ollowing m(or-
ntalion:
(i) The type and number of plugs to be used:
Oq The placemem a( each plug including the
elevation a(Ihe top and bonom of each plug;
(iii) The type and grade and quamity of material
to be used in plugging,
(iv) The method of placement a( the plugs:
(v) Any proposed test or measure to be made:
(vi) The amount, size, and location (by depth)
of casing and any other materials to be left m the
well;
(vii) The method and location where casing is
to be paned, if applicable:
(via) The procedure to be used to meet the rc-
quiremenls a(paragraph Id)IS) of this section;
Ox) Tht estimated cost of closure: and
(z) Any proposed test or measure to be made.
(5) The Direnor may modify a closure plan fol-
lowing the procedures of § I?4.5
(6) An owner or operator o(a Class 1 hazardous
wave injection well who ceases injection tempo-
rarily, may keep the well open provided he~
(i) Has received authorization from the Diecmr:
and
(ii) Has described actions or procedures, smis-
(actory to the Director, that the owner or operator
will take to ensure that the well will not endanger
USDWS during the period of temporary Jisusr.
These anions and procedures shall include compli-
ance with the technical rcyuirrmems apphwble to
arrive injection wells unless waived by the Dtrcc-
lar.
(7) Thr owner or optrmor o(a well that has
ceased operations for more than two years shall
notify the Director tU days prior m resumrng optrv
anon of the well.
(b) Notice of intent ra close. Tht owner or oper-
ator shall notify the Director m least 60 days be-
fore closure of a well At the discretion of the Di-
rector, a shover notice period may be allowed.
(d Closure repnrr. Within 60 days after closure
or at the lime of the next quarterly report (which-
ever ales) the owner or operator shall submit a
closure report to the Director. If the quarterly re-
port is due less than IS days after completion of
closure, then the report shall he submined within
60 days aher closure. Tht rcpon shall be certified
as accurate by thr owner or operator and by the
