It is not determined whether this removes the Black <br />Hawk Central City Sanitation District sewer line from the list of <br />structures within 200 feet of the affected area. The change in access <br />point will cause any pavement at the Clear Creek Convenience Store <br />entry and potentially permanent signage for that same site to be within <br />the 200-foot structure boundary. The effect of this change on Exhibit S <br />is noted below. <br />Responses to the DMG adequacy review follow exhibit numbers and headings <br />established in the Division's January 21, 2005, letter. <br />6.4.1. Exhibit A. <br />There is no inaccuracy in Exhibit A of the DMG MMRR Quarry application. <br />Referring to comments submitted by I.M. and L.M. Turner, the City of <br />Blackhawk asks in its December 30, 2004, letter "whether a discrepancy <br />does exist in the applicant's proffered legal description of the property, as <br />the Turners have suggested." In fact, the Turners' December 11, 2004, <br />setter noted an error on Exhibit C-1 regarding designated ownership of <br />adjacent properties. This error is addressed under 6.4.3, Exhibit C, below. <br />The legal description provided in Exhibit A involves no property in Section <br />24, and the Turners' comment regarding Section 24 does not provide any <br />basis for the City of Blackhawk to question the accuracy of the legal <br />description of the permitted area in Exhibit A. <br />6.4.3. Exhibit C. <br />Contiguous Property Owners. Exhibit C-1 has been corrected based on <br />the clarification provided by I.L. and L.M. Turner. We have thoroughly <br />reviewed Exhibit C-1 and updated the fist of property owners and <br />addresses based on a complete survey conducted in February 2005 of <br />Gilpin County Assessor records for the area. It appears that several <br />records for the area have been updated since the initial production of <br />Exhibit C-1 and the MMRR Quarry submittal package. We have <br />attempted to rely on the public record to the extent possible, but the <br />Assessor's records for the area may be changing on a regular basis with <br />updated information. <br />Revisions -Exhibit C-2A Construction of Main Access Road. <br />Revisions -Exhibit C-28 Mining Plan Map. <br />Revisions -Critical Cross Sections 10-Year Plan. <br />Revisions -Critical Cross Sections Processing/Plant Area. <br />Following receipt of the DMG adequacy letter, the engineer involved in <br />permit preparation, Ramsay M.
