The Division of Minerals and Geology (Division) is required to <br />make an approval or denial decision no later than May 17, 1999, therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. If <br />you feel more time is needed to complete your reply, the Division can grant an extension to the <br />decision date. This will be done upon receipt of a written waiver of your right to a decision by <br />May 17, 1999 and request for additional time. This mus[ be received no later than the deadline <br />date. <br />1. As required by Rule 1.6.2 (I)(d), please submit the proof of publication of the public notice <br />circulated in the local newspaper. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />2. Please identify the adjacent property owners that aze within 200 feet of the affected area. As <br />required by Rule 1.6.2(1)(e), provide proof of notices to all surface and easement holders that <br />are tvlthin 200 feet of the boundary of the affected land. A copy of the signed, certified mail <br />return receipt card is acceptable. <br />3. Rule 6.3.3(b) requires the applicant to specify how topsoil will be stockpiled and stabilized <br />with a vegetative cover until reclamation. Please specify the topsoil pile slopes and seed <br />mixture that will be used to stabilize the pile from wind and water erasion. <br />4. Please be advised that you may need a Stormwater Permit from the Colorado Department of <br />Public Health and Environment, Water Quality Control Division. If any storm water control <br />structures are required to be corLStructed at the mine site as a result of the storm water <br />
