Item ii7 Sediment Pond <br />~, This pond must be left since the access road is built on the <br />embankment of the pond. It is a small pond covering less than 0.5 <br />acres and does contain water in the spring and during wet years, <br />water is present into the summer months. <br />Rule 4.16.3 requires that the alternative use of the areas <br />mentioned above must be compatible with adjacent uses. Since the <br />surrounding areas are used for grazing, wildlife habitat and <br />recreational use (hunting), there is no conflict with the <br />proposed recreational use of the areas listed above. Since these <br />areas have actually been used for recreational use since 1985, <br />there is no need for a time deadline for when the proposed use <br />goes into effect. <br />The proposed use is also compatible with local, State and Federal <br />land use policies. Zoning changes are not needed. The County is <br />fully aware of the hunting and fishing operation at the site. <br />Specific plans demonstrating that the proposed land use change is <br />feasible are also not needed since it already is in use and has <br />been since 1985. The use of these areas for recreational use has <br />not posed any present or future hazard to public health or safety <br />and the environment has not been negatively impacted in any way. <br />There is no threat of possible water diminution or pollution <br />contrary to State or Federal laws. <br />Since the areas are small and do not involve leaving bare soil, <br />there are no measures to mitigate adverse effects to fish, <br />wildlife and the environment. The well-compacted nature of the <br />roads and the storage pad has resulted in little erosion over <br />many years and leaving the two sediment ponds actually helps trap <br />any sediment leaving the reclaimed areas, although very little <br />sediment has ever made its way to the ponds. The landowners are <br />actually stocking the ponds in the area and are using the site to <br />increase fish habitat. Also, the landowners have a well- <br />established and lucrative hunting business on the site. They will <br />not allow any item to remain from the mining operation that would <br />impact the wildlife in the area.
