Item ii7 Sediment Pond
~, This pond must be left since the access road is built on the
embankment of the pond. It is a small pond covering less than 0.5
acres and does contain water in the spring and during wet years,
water is present into the summer months.
Rule 4.16.3 requires that the alternative use of the areas
mentioned above must be compatible with adjacent uses. Since the
surrounding areas are used for grazing, wildlife habitat and
recreational use (hunting), there is no conflict with the
proposed recreational use of the areas listed above. Since these
areas have actually been used for recreational use since 1985,
there is no need for a time deadline for when the proposed use
goes into effect.
The proposed use is also compatible with local, State and Federal
land use policies. Zoning changes are not needed. The County is
fully aware of the hunting and fishing operation at the site.
Specific plans demonstrating that the proposed land use change is
feasible are also not needed since it already is in use and has
been since 1985. The use of these areas for recreational use has
not posed any present or future hazard to public health or safety
and the environment has not been negatively impacted in any way.
There is no threat of possible water diminution or pollution
contrary to State or Federal laws.
Since the areas are small and do not involve leaving bare soil,
there are no measures to mitigate adverse effects to fish,
wildlife and the environment. The well-compacted nature of the
roads and the storage pad has resulted in little erosion over
many years and leaving the two sediment ponds actually helps trap
any sediment leaving the reclaimed areas, although very little
sediment has ever made its way to the ponds. The landowners are
actually stocking the ponds in the area and are using the site to
increase fish habitat. Also, the landowners have a well-
established and lucrative hunting business on the site. They will
not allow any item to remain from the mining operation that would
impact the wildlife in the area. It is too crucial to their
business.
I•
B'~I93
/-2='IyC
