Part I <br />Page No. 10 <br />Permit No.: CO-0045225 <br />(3) The written authorization is submitted to the Division. <br />If an authorization as described in this section is no longer accurate because a different individual or position has <br />responsibility for the overall operation of the facility, a new authorization satisfying the requirements of this <br />section must be submitted to the Division prior to or together with any reports, information, or applications to be <br />signed by an authorized representative. <br />The permittee, or the duly authorized representative shall make and sign the following certification on all such <br />documents: <br />'I certify under penalty of law that this document and all attachments were prepared under my direction or <br />supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate <br />the information submitted. Based on my inquiry of the person or persons who manage the system, or those <br />persons directly responsible for gathering the information, the information submitted is io the best of my <br />knowledge and belief, true, accurate and complete. I am aware that there aze significant penalties for submitting <br />false information, including the possibility of fine and imprisonment for (mowing violations.' <br />2. Special Re,portin~ <br />The permittce must comply with the notification and reporting requirements associated with the annual precipitation and <br />storm event exemptions listed in the terms and conditions of the pemrit. <br />E. SPECIAL REQUQ2EMENTS <br />I. Materials Containment Plan <br />Pursuant to Sections 6.9.3 (6) and (9) of the Regulations for the State Discharge Permit System, the permittce is <br />required to submit a Materials Containment Plan. Such a plan shall be submitted to the Division within ninety (90) <br />days after the effective date of this permit and must be implemented. T'he plan shall include information and procedures <br />for the prevention and containment of spills of materials used, processed or stored at the facility which if spilled would <br />have a reasonable probability of having a visible or otherwise detrimental impact on waters of the State L ~. The plan <br />shall include, but not necessarily be limited to: <br />a. A history of the spills which have occurred in the throe (3) years preceding the effective date of this permit. T'he <br />history shall include a discussion on the cause of the spills and the preventative measures designed to eliminate <br />them from reoccurring; <br />b. A description of the reporting system which will be used to notify, at a minimum, responsible facility <br />management, the Division, the Environmental Protection Agency, downstream water users within 5 miles <br />downstream of the facility, and local health officials; <br />c. A description of preventative facilities (including overall facility plot) which prevent, contain, or treat spills and <br />unplazmed discharges; <br />d. A list which iucludes the volumes or quantities of all materials used, processed, or stored at the facility which <br />represent a potential spill threat to surface waters. 1Tre location of stored material shall be indicated on the <br />facility plot submitted for item c; <br />e. An implementation schedule for additional facilities which might be required in item c, but which are not yet <br />operational; <br />f. A list of available outside contractors, agencies, or other sources which could be utilized in the event of a spill in <br />order to clean up its effects. If the Cacility is capable of handling spills in-house, this shall be documented in the <br />plan; <br />
