SECTION E: MONITORING AND COMPLIANCE <br />12. Are the facility conditions properly reflected by the permit?N <br />if no, identify the differences: <br />The present permit does not reflect the amendments that were made <br />to the site. The amendments are reflected in the permit that goes <br />into effect December 12, 2001. <br />Is there a need for extra permit conditions? N <br />13. Describe the physical condition of each discharge point. Is it <br />discharging? If so, at what flow? <br />The three ponds that had been constructed was one at the coal <br />loadout and two sites along Jeff Canyon. No discharge was <br />occurring as the ponds had just recently been constructed and <br />there has not been measurable precipitation. <br />Discharge Point 009a - Latitude 37 06.95 and Longitude 104 47.75 <br />Discharge Point 009 - Latitude 37 07.20 and Longitude 104 47.77 <br />Discharge Point Ol0a - Latitude 37 07.20 and Longitude 104 46.42 <br />0.00000 MGD <br />14. Is the permittee maintaining records as required in the permit? Y <br />15. Are there any impoundments, land application, or ground water <br />monitoring wells present? Is there potential ground water impact? Y <br />If so, please explain in detail. <br />There will be numerous ponds located on site. The native soil was <br />being compacted during construction. As the ponds will retain <br />surface runoff, the potential groundwater impact appears minimal. <br />16. Flow measurement present? N <br />If so, please describe the device and outfall. <br />Flow measurement must be provided. <br />17. Is the effluent in compliance with the permit? Y <br />18. Is there a compliance schedule? Y <br />Is the entity meeting the compliance schedule? <br />A Materials Containment Plan must be submitted. <br />19.
