Bruce Addington
Lorencito Coal Company, LLC
December 4, 2001
Page 2
after the efTective date of the permit. The plan shall include information and procedures for the prevention
and containment of spills of materials used, processed or stored at the site, which if spilled would have a
reasonable probability of having a visible or otherwise detrimental impact on state waters. If the plan has
been submitted, please provide the date it was submitted, and any updates that may have occurred.
Noted Items:
4. The legal and facility contacts listed on the discharge permit are no longer current. To amend the permit to
reflect the new legal and facility contacts, mailing addresses, and telephone ntunbers, the Division must be
contacted, in writing, of the change.
5. Due to the construction activities, there is severe soil erosion potential unless prevention practices are utilized.
During the inspection, practices such as silt fences and hay bales were not observed in the areas disturbed by
the construction acti~nties. The erosion prevention techniques from [he Stormwater Management Plan
contained in the your Stormwater Dischazge Permit CDPS No. COR-040202) must be implemented to
minimize the potential for soil erosion to impact state waters.
6. It appeared that water from nearby coal degasification wells was being used for dust suppression on the roads.
This type of activity requires authorization from the Oil and Gas Conservation Commission, which regulates
disposal by road spreading on lease roads outside sensitive azeas. However, documentation of authorization
was not available during the inspection. If road spraying with the well water is to be utilized in the future,
authorization for the activity shall be obtained from the Oil and Gas Conservation Commission and the
records maintained at the facility.
Thank you for your staffs time and cooperation during the inspection, your effort to maintain compliance is
appreciated and encouraged. If you have any questions, or require additional information, I can be reached at 719-
545~650.
Sincerely,

David W.
