This letter is also to advise you of violations of the Colorado Water Quality Control Act. These violations <br />require a written response, no later than January 7, 2002, outlining your course of action to correct Items 2, 3, 4, <br />and 5. During the inspection the following violations, and other items, were noted: <br />Violation: <br />l . To comply with the Colorado Operator Certification Law (25-9-100, C.R.S. 1973), you must either obtain the <br />services of a certified Industrial Wastewater Treatment Plant Operator or have someone take the required <br />examination and become certified for your facility. While a January 29, 2002 rulemaking hearing before the <br />Water and Wastewater Facility Operators Certification Board will address the proposed addition of a Class <br />"D" Industrial Wastewater Treatment Certification that would include stormwater runofYcontrol ponds, <br />presently this facility requires a Class "C" Industrial Wastewater Treatment Certification. The Class "C" <br />certification is being required since the Class "D" certification will not be available before the Spring 2002 <br />exam cycle registration closing date of December 15, 2001. Information on the certification process, and <br />application forms for examinations, can be obtained from the Colorado Water and Wastewater Facility <br />Operators Certification Board, 4300 Cheny Creek Drive South, A-5, Denver, CO 80246-1530, by contacting <br />Betsy Beaver at 303-692-3503, or via the Internet at www.edphe.state.co.us/oo/ocb/ocbhom.asp. <br />2. There was no flow measurement device (e.g. weir, flume, etc.) on the outfalls for the settling ponds. To <br />comply with Part I.E.S of the dischazge permit, flow measurement must be installed to give representative <br />values of the effluent quantities at all [he respective discharge points. Please provide documentation on the <br />method of flow measurement that will be utilized to record the flow within 10% of the actual quantity. <br />3. A materials containment plan was not available during the inspection, and it was not known if one had been <br />prepared and submitted. To comply with Part I.D.I of the discharge permit, a materials containment plan <br />must be developed, implemented, and submitted to the Water Quality Control Division (the Division) 90 days <br />
