Such increase shall <br />be determined as follows: <br />(i) As promptly as practicable after the end <br />of the original term of this lease, the Lessor shall compute <br />the increase, if any, in the cost of living for the preceding <br />ten-year period based upon the "U. 5. Consumer Price Index <br />Eor all Urban Consumers (CPI-U) Eor the Denver, Colorado <br />Metropolitan area, Index 1967 = 100" (hereinafter called the - <br />Index), published by the Bureau of Labor Statistics of the. <br />United States Department of Labor. <br />(ii) The Index number. indicated in the column for <br />the City of Denver, entitled "all items," Eor the month of <br />January 1978 shall be the "base Index number" and the <br />corresponding Index number for such month in 1988 sha 11 be <br />the "current Index number." <br />(iii) The current Index number shall be divided by <br />the base Index number. The quotient thereof shall be <br />multiplied by the aforesaid 52,500.00 to arrive at the revised <br />rental. . _.. <br />(iv) The Lessee shall, within a reasonable time <br />after obtaining the appropriate data necessary for computing <br />such increase, give the Lessor notice of any increase so <br />determined and the Lessee's computation thereof shall be <br />conclusive and binding unless the Lessor shall within fifteeh <br />(15I days after the receipt of such notice notify the Lessee <br />of any claimed error therein. Lessee's computation shall <br />~ not preclude any adjustment which may be required in the event <br />• of a published amendment of the Index figures upon which the <br />computation was based. <br />(v) If publication of the aforesaid Index shall be <br />discontinued, the parties hereto shall thereafter accept <br />comparable statistics on the cost of living for the City of <br />Denver, as they shall be computed and published by an agency <br />of the United States or by a responsible financial periodical <br />of recognized authority then to be selected by the parties <br />hereto. <br />In the event the cost of living shall decrease <br />during such previous period, the aforesaid $2,500.00 rent <br />shall remain in effect. <br />3. In the event Lessee shall exercise his option <br />to extend this lease for the second additional ten-year term, - <br />the rental during such term shall again be increased by a <br />percentage equal to the cost of living percentage increase <br />during the ten years of the first additional ten-year term <br />hereof. Such increase shall be determined in accordance <br />with the same formula set forth above except that the <br />"current Index number" shall be index number for January 1998. <br />In the event the cost of living shall decrease during such <br />• previous period, the rent for such second ten-year term shall <br />remain equal to the rent in effect for the first ten-year term. <br /> <br />_;_ <br />
