C~ <br />Case No. 94CR'036, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Absolute and Conditional Ground <br />Water Rights, Plan of Augmentation and for Change of Water Rights, <br />Application of the CiTy of Black Hawk, <br />Page 21 <br />decree sought by this application. No appropriative right of exchange is sought to be decreed in this <br />matter, Applicant asks the Court to decree that it has the right to use, reuse, successively use and <br />dispose of, by sale, exchange or otherwise use to extinction all water lawfully diverted and/or <br />impounded for the changed water rights after required return flows have been made. Exhibits 2 and 3, <br />which are attached hereto and incorporated herein by this reference, are maps showing the <br />approximate location ofhistoric use, respectively, ofthe Farmers Reservoir and Irrigation Company, <br />Standley Lake Division water rights and of the 20.25 Church Ditch inches to be changed pursuant to <br />this paragraph 19. Pursuant to the Court's January 29, 2003 Order herein, the place of use for the <br />11.61 FRICO shares and the 20.25 inches in the Church Ditch is changed to include the City of Black <br />Hawk's water service area as it presently exists and as it may exist in the future. <br />19.d. Alternate points of diversion and places of storage: Black Hawk may <br />divert and store the water rights being changed at one or more of the following alternate points of <br />diversion and places of storage located at or downstream of the Church Ditch's headgate on Clear <br />• Creek, provided that for the FRICO shares, such use is made pursuant to the Rules and Regulations <br />of FRICO. <br />19.d.(1) Legal descriptions: <br />19.d,(1)(a) Church Ditch Clear Creek diversion point, located in the <br />NW'/4 NE'/4 of Section 32, Township 3 South, Range 70 West of the 6th P.M., Jefferson County. <br />19.d.(1)(b) Farmers' High Line Canal Clear Creek diversion point, <br />located in the NW'/< SW'/a of Section 27, Township 3 South, Range 70 West of the 6th P.M., <br />Jefferson County. <br />19.d.(1)(c} The Agricultural Ditch Clear Creek diversion point: <br />located at a point on the South Bank of Clear Creek in the SW'/a, Section 27, Township 3 South, <br />Range 70 West of the 6th P.M., Jefferson County. <br />19.d.(1)(d) Croke Canal Clear Creek diversion point, located at a <br />point on the north bank of Clear Creek in the NW'/< NE'/< of Section 26, Township 3 South, Range <br />70 West of the 6th P.M., Jefferson County. <br />19.d.(1)(e) Lee, Stewart and Eskins Ditch Clear Creek diversion <br />point, located on the south bank of Clear Creek in the SE'/<NE'/< of Section 27, Township 3 South, <br />• Range 70 West, Jefferson County. <br />
