Since rite January 12 meeting, I3MRI Itas been <br />consistently advised that your office was satisfied with the tc:cltnical approach being taken by <br />RMRI 1'o date ettd that the appropriate regulatory £rsmework with which to address these issues <br />was in Ute context of fire DMG response actions and the stormwatcr program. As recently as <br />Tuesday, August 3, 1.999, your office confirmed tJtis when a permit writer advised AMRI's <br />consultant in a discussion regarding Ute development of Utis application that, based upon prior <br />dtscuesions, Ire did not anticipate Ute hydrologic connection or seepage front: issues would he. <br />covered under a standard NPdES permit.. <br />AMRI is nevertheless submitting this application to over fire seepage front in art abundance of <br />caution. We recognise that Ute submittal of such en application will present a matter of first <br />impression for your office and expect to work clossly wiUt your staff in the development of. rite <br />permit terms. Moreover, because lire technical response to Ute seepage front is at fire core of <br />TR-2G, AMRI believes it will he imperative that lour office coordinate closely with DMG as it <br />moves forward with review end approval of that ptoposa.l. <br />We would.aleo note that fire enclosed application reflects Earth Sciences Inc. ea the current <br />owner of fire property. As of fire date of this letter BMRI Itas been unable to contact. 1351 <br />management t:o obtain its signature on the application form. Therefore, at Utia time fire enclosed <br />application is signed only by AMRI as the operator. Further, we would advise you that AM.RI is <br />in rite process of acquiring the underlying property and intends to complete that transacl.ion prior <br />to permit issuance. We will advise you of Ute status of. property owners)tip as the transaction <br />progresses. <br />AMRI looks forward to completing this permitting activity at Ute earliest possible de1:e and will <br />cooperate with your staff in attaining that goal.
