., <br />',~ Imo` <br />Summary of the Battle Mountain Resources, Inc. Discharge Permit Status: <br />The original draft discharge permit (CDPS permit number CO-00456751 for the Battle Mountain Resources, <br />Inc. (BMRI) San Luis Mine facility went to public notice on March 31, 2000. During this first public notice <br />period, the Water Quality Control Division received many written comments and requests for a public <br />meeting. A public meeting was held in San Luis, Colorado on June 27, 2000. The WQCD reviewed <br />comments and revised the BMRI permit, which went to the second public notice on August 4, 2000. A <br />second public meeting is scheduled in San Luis (at the San Luis Cultural Center for the Arts) for September 6, <br />2000. <br />This permit is for discharges from a former gold mine and mill operation. Active mining was completed at the <br />site in October 1996. The site has been undergoing closure and reclamation activities since that time in <br />accordance with the Division of Minerals and Geology (DMGI mining permit (permit number M-6B-1121. <br />The CDPS permit includes two discharge points. Neither of these outfalls includes discharges associated with <br />the mining process waters or the mill process waters. The main discharge involves groundwater that is <br />pumped from the backfilled West Pit and then treated in a wastewater treatment system prior to discharge to <br />the adjacent surface waters (the Rito Secol. The second outfall addresses any potential discharges from a <br />historic seepage area that is associated with the backfilled West Pit; however, no discharge should occur from <br />this source with the permit requirement for pumping and treating this groundwater in order to maintain a <br />groundwater level in the West Pit below the level of the Rito Seco. This requirement is included to ensure <br />that no further seeps will flow from the backfilled West Pit into the Rito Seco. <br />Based upon a review of applicable information submitted and comments received so far, the Division has <br />made a determination that this permit will be issued, because there is no reasonable or justifiable basis for <br />denying the application. Based upon (11 the treatment provided for the 001 discharge, 21 the implementation <br />of limitations, best management practices, remediation measures, and other requirements for outfall 002, 31 <br />the monitoring requirements for the discharges, and 41 the additional groundwater and surface water <br />monitoring, this permit will comply with ensuring that the applicable water quality standards and other <br />applicable requirements will be met. Thus, following the receipt of written comments during the second <br />public notice period and from the second public meeting,'the Division intends to review the comments, make <br />any necessary changes, and finalize and issue this discharge permit. <br />
