COLORADO DEPARTMENT OF PUBLIC flF.91.77t AND ENVB20NM£M, Water Quality Control Division
Rarionak -Page 2. Permit No. COG-SOOC~00
r
•,
The federal effluentguidelines that govern dischargesfrom sand and gravel miningfacilities (40 CFR 436) control most surface runo„
from mining facilities. However, there are some sources ofstormwater from these sires which are not addressed, such as roads and
railroad lines, pond ouulopes, inactive loadauts, sites used for storage and maintenance of material handling equipment, etc.
For sand and gravel operations, other mining and quarrying ojnanmetallic minerals except fuels, and for asphalt and concrete batch
plane located at such facilities, this general permit will cover both the process water discharges and stormwater discharges. Process
water discharges are addressed under Part IB of the permit; stormwater discharges are addressed under Pan I.C ojthe permit.
This will eliminate the need for coverage under more than onepermitfor most such facilities. However, as discussed in Section V.A1.a
of the Rationale, some facilities may wish to apply for an individual permit instead, in order to sake advantage of somefedera! effluent
guidelines not included here. Additionally, as discussed in Section III B of the Rationale, the Water Quality Control Division of the
Colorado Department ofPublic Health and Environment (the "Division') retains the authority to require any facility to be covered under
an individual permit.
III. COVERAGE UNDER THIS PERMIT
A. Industrial Categories
The types ojjacilities covered by this permit include all mining and quarrying ofnonmetallic minerals, exceptfuels. This is the
description of Standard Industrial Classification (SIC) Code 14. Also, siormwa[erfrom asphalt andconcrete batch plane located
at sand and gravel operations is included here, due to their similarity to the covered mines in pollution potential, and their
function as an adjunct to the mine operations. (The definition of asphalt and concrete batch plants can include the use of
rerycled asphalt or concrete.) The categories include: '
S!C Code Industry Type
SIC Code Industry Type
14I Dimension stone 148 Nonmetallic minerals services, except fuels
141 Crushed and broken stone (overburden removal, strip mining, etc.)
144 Sand and gravel 149 Miscellaneous nonmetallic minerals, except
/45 Clay, ceramic, and refractory minerals fuels (asbestos, gems, fill dirt pits,
147 Chemical and fertilizer mineral mining graphite, gypsum, peat, pumice, talc, etc.)
1951 Asphalt batch ptanu 3273 Concrete batch plane
B. Exemptions for Small Municipalities
The Intermoda! Surface Transportation Efficiency Act oj1991 Section 1068(c) added an exemption to thestormwater regulations
for municipalities with less than 100, 000 populatio». The term "municipality" includes cities, towns, counties, special dutricu or
any entity created by or pursuant ro State law.
Starmwater discharges associated with industrial activity (except for airports, steam electric power plane, or uncontrolled
sanitary landfills), that are owned or operated by a small municipality are not required to applyjororobtain a stormwaterpermit
until March 10, 1003. This exemption is only for discharges of stormwater. (Note: This exempton does no[ apply to other,
privately owned industries within the same small municipality.)
1 Iv.
CERTIFICATION
A. Permit Certifications
This permit it made up of several pare, same of which do not apply to all permittees (i. e., while most facilities will require
coverage under the stormwater section I C, many will not require coverage under the process water section I.B). Therefore, the
individual certiftcatiort preparedfor each applicant will indicate whether that applicant must followPart IB afthepermit. In all
cases (except as noted in Section ]II.C, above), Part I C must be followed. (In the absence of such indication from [he Division,
the permiaee will be responsible for determining and then complying with the applicable sectiorss in Part I) In addition, all
permirrees will be required to comply with Pan 1, subparts A, D, E and F, and all of Pan II of the permit.
