PUBLIC NOI7CE CHANGES <br />UPDATE <br />This is for the renewal ojthegeneral sand and gravel permitfirst issued on October 28, 1481, with reissuances on June 10, 1987, August <br />31, 1991, and.4ugust 31, 1997. The Genera/ Permit system jot regulating sand and gravel production operations has worked wel/for <br />the Stare of Colorado. <br />The following minor changes have been made to the permit and Rationale during renewal: <br />A. Small MunicipalityF,xemption: The RationalediscussiononthestormwaterpermittingF.xemptionsforSmallMunicipatitie.~ <br />(Section III.B) has been changed ro include the March 10, 1003 deadline for permit coverage jot municipally owner' <br />industries. This did not involve any changes to the permit. <br />B. Reapplication: Authorization to discharge under this general permit will expire on September 30, 2007. For cerrificatiwa <br />covering stormwater discharges only (i. e., the permittee's individual certification does not indicate that Parr LB of tl: - <br />permirmust be followed), the deadline for reapplication for continued coverage under the generalpermit has been changr~ <br />to ninety-days prior to permit expiration, or June 30, 2007. Impacted Stream Segmenu: For this general permit, any existing or new operation that discharges to a segment that is !i <br />on the Division's 303(d) list of impacted stream segmenu may require an individual permit The 303(d) segmenu <br />segmenu in which water quality standards for one or more pollutanu are exceeded. <br />For most, ifnot all, of the operations that discharge under thispermit, there are no monitoring data to verify the expecu.~ <br />that these discharges will not impact a listed segment. Therefore, for those facilities that discharge process wat~• <br />segmenu on the 303(d) list, the permitrees will be required to perform a one-time analysis upon commencement ofdiscl,•= <br />for the listed parameters ofconcern ro confirm that stream standards for these parameters are nor exceeded in the discF,a <br />cancenrrarions. <br />Where the receiving water is included on the state's 303(d) list, total maximum daily loads (TMDLs) are being develol~« <br />accordance with the Division's schedule for TMDL completion. Thej <br />would continue to be covered under this general permit cert~cation until the individual permit is issued. <br />II STORMWATER PROGRAM <br />As required under the Clean WaterAct amendmenu of1987, the Environmental Protection.fgency (EPA) has established afrm <br />for regulating municipal and industrial stormwaterdischarges. This framework is under the National Pollutant Discharge Elin <br />System (NPDES) program. The regulations (40 CFR 12216) require specif[c types of industrial facilities which discharge slot <br />associated with industrial activity (i»dustria/ stormwater), to obtain coverage for this discharge under an NPDESpermit F <br />which discharge industrial stosmwater either directly ro surface waters or indirectly, through municipal separatestorm sewers, <br />covered by a permit. <br />
