. .. <br /> <br />conditions shall be made by the Little Snake Resource Area Manager in consultation with the <br />Colorado Division of Wildlife, (CDOW). When the determination has been made that severe <br />winter conditions exist, the authorized officer shall notify the licensee that the waiver is <br />terminated and no new drilling starts will be allowed and all on-going operations will cease <br />no later than 5 days from the date of notification. Drilling shall be allowed to resume when <br />BLM and CDOW determine that conditions have moderated to the point where big game ate <br />no longer in danger. <br />(e) No operations shall be conducted on proposed drill sites FED-4, FED-39, FED-42 <br />and FED-45 from February 1 through July 31 to protect nesting raptors. <br />(f) To avoid disturbance to nesting sage grouse and sharp-tailed grouse habitat, no <br />operations associated with FED-13 through FED-16 and FED-38 shall be conducted from <br />Mazch 15 through June 30. If a survey is conducted and it is determined that suitable nesting <br />habitat is not present, no timing restriction shall be applied. This restriction may be waived if <br />a survey, approved by the authorized officer, indicates the area is unsuitable for nesting <br />habitat. <br />(g) Surface disturbing activities in wetland and riparian azeas shall be avoided. <br />(h) Rutting shall be mitigated according to surface owner agreements. In the absence <br />of a surface owner agreement specifying surface rutting, the following guidelines shall be <br />followed in order to minimize erosion resulting from ruts. <br />(1) Overland travel segments that traverse approximately perpendicular to the <br />contour of the slope shall not be used if surface rutting will exceed 2 inches. <br />(2) Two-track roads can be used if rutting depth remains below 3 inches. <br />However, water bars to divert runoff water from the road tracks or other mitigative measures <br />may need to be employed if tuts caused by the operations in excess of 2 inches remain after <br />30 days from the conclusion of operations in that area. <br />(3) Bladed or improved road segments that had topsoil salvaged prior to <br />commencement of operations shall not have a rutting depot restriction. However, <br />maintenance, reclamation or other stabilization measures to control surface runoff and <br />minimize soil erosion shall be employed within 15 days. <br />(i) Pursuant to 43 CFR 10.4(8), licensee must notify the authorized officer by <br />telephone and written confirmation immediately upon the discovery of human remains, <br />funerary items, sacred objects, or objects of cultural patrimony. Further, pursuant to <br />43 CFR 10.4(c) and (d), licensee must stop activities in the vicinity of the discovery and <br />protect it for 30 days or until notified to proceed by the authorized officer. <br />(j) Control of noxious weeds shall be required through successful vegetation <br />establishment and/or herbicide application. Applications of herbicide are prescribed. <br />However, it is the responsibility of the licensee to insure compliance with all local, state and <br />federal laws and regulations, as well as labeling directions specific to the use of any given <br />herbicide. <br />(k) A Pesticide Use Proposal (PUP) shall be approved prior to application of <br />herbicides and/or other pesticides on federal surface;contact the Little Snake Resource Area <br />office to obtain a PUP form to request this authorization.
