', <br /> <br />6 <br />Sec. 11. RELINQUISHMENT OF LICENSE--The licensee may relinquish this license, in <br />whole or in part, by filing in the Colorado State Office a written relinquishment The <br />relinquishment shall be effective the date it is filed, subject to the continued obligation of the <br />licensee and his surety: (a) to comply with the terms and conditions of the license, the <br />exploration plan, and the regulations and, (b) to provide for the preservation of any permanent <br />improvements on the licensed lands. <br />Sec. 12. REVOCATION OF LICENSE--This license may be revoked for noncompliance <br />with the terms and conditions of the license, the approved exploration plan, or the regulations <br />after the licensee has been notified of such violation and the licensee has failed to correct the <br />violation within the time specified in such notice. <br />Sec. 13. EQUAL OPPORTUNITY CLAUSE--This license is subject to the provisions of <br />Executive Order No. 11246 of September 24, 1965, as amended, which sets forth the <br />nondiscrimination clauses. A copy of this order may be obtained from the issuing office. <br />Sec. 14. STIPULATIONS--(a) All lands not previously inventoried for cultural resources <br />shall be inventoried in accordance with Sec. 6(a) of this license prior to surface disturbing <br />activities. Two copies of the report for this inventory shall be prepared and forwarded to the <br />Little Snake Resource Area Manager and upon approval by the azea manager, operations may <br />proceed. <br />(b) If buried cultural or paleontological resources are discovered during exploration <br />operations under this license, the licensee shall immediately notify the Little Snake Resource <br />Area Manager and shall not disturb such discovered resources until the Area Manager issues <br />specific instructions. <br />(1) Within 5 working days after notification, the Area Manager shall evaluate <br />any cultural resources discovered and shall determine whether any action may be required to <br />protzct or to preserve such discoveries. <br />(2) The cost of data recovery for cultural resources discovered during <br />exploration operations shall be borne by the licensee, if the licensee is ordered to take any <br />protective measures. Ownership of any discovered cultural resources shall be determined in <br />accordance with applicable law. <br />(c) All waste material shall be contained on site in a trash cage or other portable <br />storage device and hauled to a county approved landfill. No hazardous materials or hazardous <br />waste or trash shall be disposed of on lands under this license. If a release does occur, it <br />shall be reported to the Little Snake Resource Area Manager immediately. <br />(d) To avoid disturbance to wintering mule deer and elk, no operations shall be <br />allowed to occur from December 1 to April 30 if severe winter conditions exist on proposed <br />drill sites FED-1 through Fed-26, FED-31 through FED-44 and FED-47. This restriction may <br />be waived by the authorized officer if requested by the licensee and severe winter conditions <br />do not exist. <br />(1) Because severe winter conditions are not predictable, drilling may be <br />allowed under a waiver with the understanding that when winter conditions are determined to <br />be severe, all drilling must cease until conditions moderate.
