The basis for this section of this certification is Mined Land Reclamation Division letter, July 13, 1984, RE: <br />Professional Certification. <br />~ A statement of the professional aualitications of the certifvine urofessional. <br />Mr. Baccari was graduated from the University of Wyoming with a Bachelor Degree in General Engineering in 1964, <br />and from the University of Wyoming with a Master of Science Degree in Civil Engineering in 1965. His pertinent <br />experience includes planning, design, and construction supervision of small and medium dams, drainage structures, <br />and spillways. He has been responsible for surface and ground water hydrology smdies and storm routing studies. <br />He is a registered Professional Engineer in the States of Colorado, Wyoming, Utah, Arizona, and Montana. <br />Ll A citation of the Rule requiring the certification. <br />The requirements for this cettification are Rules 4.05.9 (10) and (11) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. <br />!~ A specific description of the subject of the certification. <br />The subject of this certification is a sedimentation pond, and concerns items (a) through (e) presented above. The <br />strucmre is an eardt embankment. Apptutenant structural elements include a primary spillway [corrugated metal pipe <br />(CMP) riser and barrel] and an emergency spillway (riprap-lined earth). The pond is identified as Pond Number 2 <br />in Permit Number C-81-026. This permit is to conduct a mining operation known as the Canadian Strip Mine for the <br />purpose of extracting coal, and was issued to SLURCO Corporation (current). The Canadian Strip Mine (including <br />the subject pond) is located in Jackson County, State of Colorado, in Township 8 North, Range 78 West, 6th Prime <br />Meridian, approximately 9 miles west of Walden, Colorado. <br />This certification is limited to the scope of Rtiles 4.05.9 (]0) and (1l) as regards the existing sedimentation pond, and <br />is based on documentation of the Permit identified in paragraph (4) below. This certification does not extend to <br />verification [hat [his information and other information found in the Permit represents existing conditions fr the field, <br />nor that the structure was designed, built, or operated in compliance with Rules 4.05.2 through 4.05.9 of Colorado <br />Mined Land Reclamation Division regulations. <br />A statement of the actions taken in preparing the certification. <br />The following were reviewed: Rules 4.05.9 (10) and (1l) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining; Mined Land Reclamation Division letter July 13, 1984, Re: Professional <br />cettification; the 4th quarter 1996 inspection report and 1996 annual certification; the 1997 quarterly inspection <br />reports; the Pond 2 Dam Cross Section and other information provided on Figure 3, Reclamation Project As-Built <br />Topography, dated l 1/10/87; Figure Q-4, Stage-Volume Analysis Sedimentation Pond N2, dated l (/29/94; Appendix <br />Q, pages Q-1 and Q-2, revised 11/30/94; SEDCAD+ Elevation-Area-Capacity-Dischazge Table, 1994 Pond 002 As- <br />Buil[ Hydraulics, 22-29-1994; the Dam Safety Manual (State Engineer's Office, June 3, 1983); and 2 CCR 402-1, <br />Rules and Regulations for Dam Safety and Dam Construction.
