~ A statement of compliance with the urudent date-of-the-a <br />The pond is in compliance with the prudent state-of-the-art. <br />~7 A statement of compliance with the approved mine plan and permit soeciPcally referencing <br />appropriate portions of the permit documents (plans. mans and text). <br />The dam is located and configured in compliance with the approved mine plan and permit (Figure 3, Reclamation <br />Project As-Built Topography, dated: 11/10/87). Vegetation on downstream slopes is sparse [Rule 4.05.6(1 l)(g)]. <br />Cleaning of the pond is not required. The pond requires cleaning when 60% of the maximum sediment level is <br />reached (Permit, Section 2.05, Page 37). The maximum sediment level is at 8216.46 (SEDCAD+ Elevation-Area- <br />Capaciry-Dischazge Table, 1994 Pond 002 As-Built Hydraulics, 22-29-1994).
