We felt it was important for the public to be aware of this and <br />therefore included Note 5 on the Mining Plan Map, "these plans are conceptual, the final <br />configuration of the slurry wall and mining pods may vary based on engineering design and/or <br />site conditions". Per your request, we have modified the language in this note to: "Hall-Irwin <br />will submit the slung wall design, specifications, and Quality Assurance plan through the <br />technical revision process.' <br />6.4.4 EXHIBIT D -Mining Plan <br />4. Page 2 of the Application Form item 13, should include: various petroleum products, <br />antifreeze, lubricating products, and hot mixes. Due to the specfic nature of the Spill <br />Prevention, Control and Countermeasures (SPCC) plan, it will not be prepared until just before <br />the start of operations at the site. We have enclosed a summary of the SPCC Plan policies <br />and procedures. <br />5. AS we mentioned in the Mining Plan, Hall-Irwin may import materials for processing, hatching <br />or blending plants and for sale at the landscape yard. At this time, Hall-Irwin does not intend to <br />backfill any of the imported material, and therefore it is not appropriate to include in the <br />reclamation cost estimate. If in the future, Hall-Irwin determines there is a need to backfill <br />imported material, we will first obtain Division approval and comply with the requirements of <br />Rule 3.1.5(9). <br />6. Please refer to the attached Reclamation Calculation Map for the acreages of the various <br />disturbances you have requested. <br />7. The proposed mining setbacks are contained in the main body of the permit application. <br />Exhibit S -Permanent Man-Made Structures contains a stability analysis that lists the <br />structures within 200 feet of disturbed areas. Based on the Stability Analysis, Hall-Irwin <br />agrees to a 55-foot minimum setback from structures. <br />Hall-Irvrin has been working with the oil and gas companies to develop agreements about each <br />entities' operations on the properly. The notes on the Mining Plan address the oil and gas <br />companies' operational needs, such as the 150 foot setback from wells and a 30 foot setback <br />from gas lines. However, they will allow Hall-Irwin to mine within 75 feet of wells on a quarter <br />circle basis. The setbacks on the Mining Plan Map reflect both the stability analysis and oil <br />and gas company requirements. For example, since the stability analysis dictates a minimum <br />setback of 55 feet from structures, Hall-Irwin will setback 55 feet from gas lines, rather than 30 <br />feet These setbacks are not only described in the Mining Plan Map "Notes°, but also shown <br />as dimensions on the drawing. Note that the map also reflects the commitment that Hall-Irwin <br />will not relocate or move any existing structures until an agreement is in place with the owner <br />of the structure. <br />
