Mr. Jatttes Striggow, Glade, LLC <br />Adequacy Review No. 2, Permit No. M-2006-021 <br />November 3, 2006 <br />Rule 6.4.14 Exhibit N -Source of Le ag I Rir~ht to Enter <br />4. The Assignment of Quarry Lease submitted with the applicants adequacy review response references a Quany Lease <br />between the landowner, Northern Colorado Water Conservancy District (NCWCD) and the Lessee, Stone Wholesale, <br />Inc. (Stone Wholesale), dated September IQ 2004 for 15 acres in subdivision W 1/2NE1/4NE1/4, Section 1, Township <br />8N, Range 70W. However, there is no Quany Lease contained with the permit application confirming that Stone <br />Wholesale has a right to mine the subject land. What is contained in the permit application is a License Agreement <br />dated May 13, 2006, granting Stone Wholesale access across the land owned by NCWCD for the purposes of mining <br />on land owned by the Colorado State Land Boazd. Therefore, please provide the Division with a copy of the Quarry <br />Lease between NCWCD and Stone Wholesale indicating that Stone Wholesale has the right to mine material from the <br />land owned by NCWCD. <br />In addition to the above adequacy review items, the Division has received an objection to the proposed mining operafion <br />from Mary Lou and Will Evans of Livermore, Colorado; a copy of which is enclosed for your reference. The Division <br />recommends that the applicant contact these objectors and attempt to resolve any issues they may have with the operation <br />and have them withdraw their objection to the Division in writing; otherwise, this application will have to go before the <br />Mined Land Reclamation Boazd for a decision as whether or not to issue the permit. <br />Please be advised that the Glade Quarry permit application may be deemed inadequate, and the application may be denied <br />on November 10, 2006 unless the above-mentioned adequacy review items are addressed to the satisfaction of the <br />Division. If you feel more time is needed to complete your reply, the Division can grant an extension to the decision date. <br />This will be done upon receipt of a written waiver of your right to a decision by November 10, 2006 and request for <br />additional time. This must be received no later than the deadline date. <br />Rule 1.8.1 states that changes and additions to the permit application must be filed with the Division and the County Clerk <br />and Recorder. The applicant must also provide the Division with an affidavit or receipt no later than the close of business <br />on the day the change was filed with the Division demonstrafing that the change or addition was filed with the County <br />Clerk and Recorder <br />If you have any questions, please do not hesitate to call.
