Heffner - 2 - May 9, 1985 <br />As per Minerals Kules and Regualtion Number 1.5b(5) "A permit shall not be <br />denied except for one or more of the following reasons: <br />(5) The mining operation will adversely affect the stability of any <br />significant valuable, and permanent man-made structures located within <br />two hundred feet of the affected land, except where there is an <br />agreement between the operator and the persons having an interest in <br />the structure that damage to the structure is to be compensated for by <br />the operator;". <br />Please provide a copy of the agreements reached with each of the <br />aforementioned "structure-owners" detailing" <br />1. The distance between Daniel's Sand Company affected land boundary <br />and the sturcture in question; and, <br />2. The compensatory measures proposed by Daniel's Sand Company if the <br />structure in question is damaged. <br />Alternatively, you may submit "proof" that the proposed mining operation will <br />not adversely affect these structures. <br />Board consideration of the application will be contingent upon receipt of the <br />documented agreements or proof as described above. <br />3. Please illustrate the location of the power poles/line on Map C. <br />4. Contrary to Exhibit D - Minin Plan, the topsoil stockpiles are not shown <br />on Map C. Please provide topsoi stockpile locations on Map C. <br />Exhibit D - Mining Plan <br />1. Upon reviewing the Annual Reports submitted for this operation, it seems <br />that Phase IW has been previously mined. Please provide total acreages and <br />location of <br />a. land previously mined; <br />b, land reclaimned; <br />c. land to be mined; and, <br />d, total affected land. <br />2. Will overburden be stockpiled for later use in reclamation? <br />3a. What are the proposed final grade(s) of the slopes around the highway? <br />3b. How are these slopes different from the present condition? <br />3c. Are these slopes included as part of the Reclamation Plan? <br />4. Topsoil stockpiles in place longer than one growing season should be <br />graded to slopes no steeper than 2H:1V and seeded with a perennial covercrop <br />for conservation purposes. Please commit to such. <br />5. What is the (approximate) total volume of topsoil available for <br />reclamation purposes? <br />
