<br /> <br />The delineations of wooded areas and farm ponds are now properly labelled on the maps. There is a wooded area <br />located in the eastern staging area, which you state will be completely avoided. The vegetation information, which <br />is reiterated from the NRCS information elsewhere in the application, is adequate. <br />The soils map will be accepted as it is now, with no further corrections required. <br />E.xhibi[ D -Mining Plan <br />You have clarified the question about the SLCRR easement, as mentioned above. Your private rail spur will <br />mostly be located on your property, within the permit area boundan~, except for the ~0-60 feet on the eastem end <br />where the connection to the existing line will be. Your mil spur does not }'et exist. Prior to the time of actually <br />connection the rail sour to the existing line, since it will be outside the permit boundary and into die railroad's <br />easement, please provide our Division a copy of the agreement with SLCRR showing [hat this connection to their <br />line is allowed. (Submittal of this agreement might become a permit approval condition, which will have to be <br />satisfied prior to spur construction or main line connection.) <br />You also clarified that there will be no mining within 300 feet of the overhead powerline or buried gosling, until <br />such time that you have secured a damage agreement with Xcel Energy, which owns those structures. Please <br />clarify however, whether there will be any road-building or haulin ag ctivity carried out in that portion of this utility <br />corridor between the mining area and the sta ing area, prior to securing_the necessary damage a¢reement(sl. <br />At this time, since no details about the structures to install or remove in the staging area have been provided yet, no <br />structuml demolition or concrete removal will be entered into the bond calculations. We can safely assume that <br />something will be constructed, possibly to be later removed, but for no~v it can be included as a small part of the <br />reclamation earthwork task. In the future, as plans for developing the staging area are finalized, please <br />communicate them to us, and we can determine if a bond adjustment is needed. <br />There may be adverse effects to the flow of water in Fish Ditch, as the ponds in Cells 3 and 4 develop in proximity <br />to the ditch. This is not a problem now, since excavation will not reach that area for many years, and since the <br />applicant is also the landowner. In the future, however, it is possible that the operator and landowner may be two <br />different entities, and addressing this situation will be important. If it is recognized that swctumi changes to the <br />ditch become necessary, the operator will have to somehow provide for the proper functioning or stability of the <br />ditch, which ntay temporarily affect die bond amount. (This issue ma}• also become a permit approval condition.) <br />Thank you for the other clarifications, which will become part of your approved plan and will be used in your bond <br />calculations. <br />Exhibit E -Reclamation Plan <br />The acreages for various activities, slope lengths and gradients, and other amounts you provided will all help in <br />setting a representative bond amount, and will become part of your approved reclamation plan. <br />Exhibit F -Reclamation Mao <br />The map now reflects the post-mining condition more clearly, wide inclusions of notes, contours, and more <br />complete labelling. It is considered adequate now. The apparent typographical error on the contour line label at the <br />southeast end of Fish Ditch (noted previously under Exhibit C above) also is on this map. Is it intended to be <br />"7635' feet? <br />Exhibit G -Water Information <br />1 reviewed the water engineer's packet, which clearly shows the intent to dry up acreage in exchange for allowing <br />evaporative losses from the 100 acres of proposed ponds. You have acknowledged that until you have been <br />approved for these ponds, mining cannot expose groundwater, or the bond amount must cover the costs of <br />adequatel}• backfilling any exposed groundwater. Please provide evidence to this Division of approval for the <br />
