There are, however, still a fe+v issues to be addressed, which I have listed below in the order <br />of the application item or exhibit to which they pertain. Besides [he underlined headings, 1 have underlined all <br />questions needing responses, since 1 have also included comments on other items in this letter, which require no <br />further response from you. <br />Application Item 3 -Permitted Acreage <br />The revised first page of the application appears to contain the correct acreage information, which now reflects the <br />total permit area [o be 220 acres. This was the best method to show the revision. <br />Application Item 7. I -Holders of Recorded Easements on the Affected Land <br />Several of the questions about this have been answered. You have identified Xcel Energy as the entity owning the <br />overhead po+verline and the buried gas pipeline crossing the site. You have clarified the fact that the extreme <br />eastern end of the permitted area will not encroach on the San Luis Central Railroad (SLCRR) easement. There is <br />an overhead telephone line crossing the site. near the location of the electric and eas corridor. which may be located <br />in its own easement and whose owner is still not identified in the file. If applicable. please provide information <br />about the telephone line easement (and other o+vnership information under Exhibit S) <br />Exhibit A -Legal Description <br />The metes and bounds description appears to be correct. The small addition of the entrance road segment on the <br />north side (an area of 200 feet x 48 feet, or 0.22 acre) was needed and appropriate. Please note, this segment of the <br />road, as well as other onsite roadways, may not require "bonding" if they are [a remain afrer reclamation. <br />Exhibit C -Pre-mining and Mining Plan Maw <br />The small area added for the haul road entrance is properly depicted on [he maps. The contour line at the southeast end of the Fish Ditch is now identified as "764" feet, [hough it may be <br />a h~pographical error for "7635' fee[ Anew map is not required, if this detail can be clarified. <br />
