Is the water to be purchased for this operation now <br />designated as industrial use water? If it is not, <br />a change in use for this water must be secured. <br />Water for use at the pit is included in our lease arrangement. <br />Procedures to obtain a change in use for this water were <br />begun upon receipt of our Pitkin County Conditional Use <br />Permit. Other than the time involved in such a process, <br />we expect no problems in this regard. <br />2. Have all permits and water rights been secured for the <br />well to be constructed at the northeast corner of the <br />site? This well site should be shown in exhibits C and/or <br />F. <br />As in the case of the aforementioned, this process had been <br />initiated. In view of the small amount of water that will <br />actually be used compared with the water available thru <br />our lease agreement, we are confident of success. <br />3. The response from the Colorado Division of Water Resources <br />has not yet come back to us on this application. If they <br />have significant comments, I will pass them on to you. <br />Noted. <br />EXHIBIT L: <br />1. Is the expected topsoil redistribution depth to be only 4"? <br />4" to 6" depth was recommended by the SCS. <br />2.
