PARr a <br />Page 37 <br />Permit No. COG~00000 <br />B. RESPONSIBILITIES <br />5. Modification. Susoeosion. Revacazion. or Terminazion of Permits By the Division (cont.) <br />a. A perrttit may be modified, suspended, or terminated in whole or in part during its term for <br />reasons determined by the Division including, but not limited to, the following: <br />(1) Violation of any terms or conditions of the permit; <br />(2) Obtaining a permit by misrepresentation or failing to disclose any fact which is <br />material to the granting or denial of a permit or m the establishment of terms or <br />conditions of the permit or <br />(3) Materially false or in~rr±,.p%. statements or infoImazion is the permit applicazion or <br />the permit. <br />(4) A determination that the permitted activity endangers human health or the classified <br />or existing uses of state waters and can only be regulated to acceptable levels by <br />permit modificaziorss or t +~at~on. <br />b. A permit may Ire modified in whole or in part for the following causes, provided thaz such <br />modification complies with the provisions of Section 6.11.0 of the Regulaions for the State <br />Discharge Permit System: <br />(1) There are material and substantial alterations or additions [o the permitted facility or <br />• activity which occurred after permit i~a+~nrr which justify the application of permit <br />conditions thaz are different or absent in the existing permit. <br />(2) The Division has received new informazion which was not available az the time of <br />permit issuance (other than revised regulations. guidance, or tat methods) and which <br />would have justified the application of diffetmt permit conditions az the time of <br />i~ ,awn~r, For permits issued to aety sources or crew dischargers, this cause includes <br />information derived from effluent toting required under Section 6.5.7(5) of the <br />Regulations for the State Discharge Permit System. This provision allows a <br />modification of the permit m include conditions thaz ate less stringent than the <br />existing permit only [o the extern allowed under Section 6.11.0 of the Regulations <br />for the State Dischazge Permit System. <br />(3) The standards or regulations on which the permit waz based have been changed by <br />promulgation of amended standards or regulations or by judicial decision after the <br />permit was issued. Permits may be modified during their terms for this cause only <br />as follows: <br />(a) The permit condition tegttested to be modified was based oa a promulgazed <br />effluea[ limitation guideline, EPA approved water quality standard, or an <br />effluent limitadoa set forth in 5 CCR 1002-3, § 10.1.0 et seq.; and <br />(b) EPA has revised, withdrawn, or modified thaz portion of the regulation or <br />effluent limitation guideline on which the permit condition was based, or has <br />approved a Commission action with tespat to the water quality standard or <br />. effluent limitation on which the permit coadidon was based; and <br />(c) The perminee tequesu tnadificazioa after the notice of final action by which the <br />EPA effluent limitation guideline, water quality standard, of effluent limitation <br />is revised, withdrawn, or modified: m <br />
