The permittee may allow a bypass to occur which does not pose effluent limitazions to be <br />exceeded, but only if i[ also is for essential maintenance or [o assure optimal operation. <br />These bypasses are not subject to the provisions of paragraph (a) above. <br />d. The Division may approve an amicipazed bypass, after considering adverse effects, if the <br />Division de[ermines thaz the bypass will meet the conditions specified in paragraph a. above. <br />14. Reduction. Loss. or Failure of Tteazarent Facility <br />The permittee hat the duty to halt or reduce azty activity if necessary to maintain compliance with <br />the effluent limitations of the permit. Upon reducflon, loss, or failttte of the *rc~**~+~r facility, <br />the permittee shall, to the extent necessazy [o maintain compliance with its permit, control <br />production, comrol sources of wastewater, or all discharges, omit the facility is restored or as <br />alternative method of treatment is provided. This provision also applies to power failures, unless <br />as alternative power source sufficient to operaze the wastewater comrol facilities is provided. <br />It shall no[ be a defence for a pertnittee in an enforcement action that it would be necessary to halt <br />or reduce the permitted activity in order ro maintain compliance with the conditions of this permit. <br />B. RESPONSIBILTfIES <br />• 1. Inspections and Ri¢ht to Entrv <br />The permittce shall allow the Division and/or the anthorized representative, upon the presentazion <br />of credentials: <br />a. To enter upon the permittee's premises where a tegulatcd facility or activity is located or in <br />which any records are tequirod to be kept under the terms and conditions of this permit; <br />b. At reasonable tithes to have aceess to and roPY any records required to be kept under the <br />terms and conditions of this permit and to inspect nay monitoring equipmem or monitoring <br />method requited in the permit; and <br />a To enter upon the pctmitttx's premises in a reasonable manner and at a reasonable time to <br />inspect and/or investigate, any actual, suspected, or potential source of wazer pollution, or m <br />ascertain compliance or non compliance with the Colorado Water Quality Control Act or a~ <br />other applipbk state ar federal statute or regulation or nay order promulgated by the <br />Division. The investigation may include, bu[ is not limited to, the following: sampling of <br />any discharge and/or process water;, the taking of pho[ographs, interviewing of nay person <br />having ]mowledge relazed to the discharge permit or alleged violation, access to nay and all <br />facilities or arras within the permittee's premises that may have any affect on the discharge, <br />permit, or alleged violation. Such entry is also authorized for the purpose of iaspetxing anti <br />copying records requited to be kept co~,Y,,,;.,g any effluent source. <br />d. The permittee shall provide access m the Division to sample the dischazge az a poim after the <br />final treataxm process but prior to the disrbarge mixing with state waters ttpon presentation <br />• of proper credentials. <br />In the making of such inspections, investigations, and rM'*++++~A~~ons, the Division, insofar as <br />practipble, may designate as its authorized representatives any qualified personnel of the <br />Depaztmeat of Agriculture. The Division may also toques[ assistance from any other state or lapl <br />agency or institution. <br />
