' ~
`, ~., ~
ti,''
:~%hr.~.w~ rJJI~iL'
• Exhibit D - A soils and geotechnical report prepared by CTL Thompson, Inc. for
Pinnacle Pines LLC in their application to Commerce City discourages using
steep slopes for long term stability. Said report can be made available to the
Division of Minerals and Tuttle Applegate, Inc., upon request. Have any soils
and geotechnical studies been complete on the applicant's site? Can all soils
and geotechnical results be made available to adjacent property owners before
any decisions are made by the Division of Minerals and Geology on the Tanabe
application?
• Exhibit G -Portions of the Phase 1 operation are located in Zone A of the
FEMA floodplain for First Creek. The application does not address the regional
impacts of storm water flows and quality. Has a CLOMER or LOMER
application been made to FEMA?
• Exhibit M -Will gravel operations require a Fugitive Dust Permit? This issue is
not specifically addressed in the application.
• There are two significant high-pressure gas mains in the vicinity of the
proposed mining operation. The application makes no mention of what
precautions will be taken to ensure the safety of the gas mains.
The application does not address the use of explosives on this site. Will
explosives be used on this site? What measures will be taken to ensure the
safe use of explosives?
• No meaningful outreach has been made to adjacent property owners to receive
their input or provide additional information. The proposed mining application
could have significant impacts on adjacent properties and a responsible
applicant should make a concerted effort to work with their neighbors.
In conclusion, this application is extremely concerning. Many health and safety issues
are not addressed and the application appears to be incomplete. Unless the outlined
issues can be satisfactorily resolved, I respectfully request the Division of Minerals and
Geology decline the Tanabe Pit Application for Regular (112) Construction Material
Operation Reclamation Permit.
If you have questions or wish to discuss my concerns further, please call me at
303.628.3800.
Sincerely,
David J. Younggren
Vice President
