./ <br />THE <br />MARY-wILLIAMS <br />COMPANY <br />March 14, 2000 RECEIVEC <br />MAR 14 2000 <br />Division of Minerals and Geology Division at Minerandtieob9l' <br />Room 215 <br />1313 Sherman Street <br />Denver, CO 80203 <br />Re: Tanabe Pit Application for Regular (112) Construction Materials Operation <br />Reclamation Permit <br />To Whom It May Concern: <br />Please allow this letter to serve as formal opposition to the Mobil Premix Concrete, Inc. <br />application for a Regular (112) Construction Material Operation Reclamation Permit for <br />the Tanabe Pit located in Section 10, Township 2 South, Range 67 West, 6`" Prime <br />Meridian, Adams County, Colorado. Gary Williams Real Estate, Inc. is the owner of 141 <br />acres and will close on another 30 acres, known at the Myers Farm this month. Both <br />properties are immediately adjacent to Tanabe property. Gary Williams Real Estate, <br />Inc., in partnership with Pinnacle Pines LLC, received approval to develop a total of 171 <br />acres for 1,000 residential units and neighborhood commercial/retail uses. This site <br />was annexed to Commerce City and zoned PUD Mixed Use in February of this year. <br />The application prepared by Tuttle Applegate, Inc. inaccurately identifies the zoning of <br />the adjacent property as agriculture. <br />It is extremely important the highest level of care be given to all proposed mining <br />permits outside of Adams County designated zone of valuable minerals. Upon <br />reviewing the application, I have the following concerns about the health and safety of <br />the proposed mining permit: <br />• Exhibit C -The application does not specifically address surface irrigation <br />facilities. How and by what methods will surface irrigation occur? <br />• Exhibit D -The application suggests gravel cuts up to 25 feet deep at Y~:1 <br />slopes. This will most likely expose ground water with potential contaminates. <br />Has the applicant tested the ground water for contamination, such as DIMP, <br />Methyl Chloride, Parathion, DDT, Malathion, Ethyl Benzine and Xylen? What <br />are the results of ground water tests?
