<br /> <br /> <br />• Exhibit D - A soils and geotechnical report prepared by CTL Thompson, Inc. for <br />Pinnacle Pines LLC in their application to Commerce City discourages using steep <br />slopes for long term stability. Said report can be made available to the Division of <br />Minerals and Tuttle Applegate, Inc., upon request. Have any soils and geotechnical <br />studies been complete on the applicant's site? Can all soils and geotechnical results be <br />made available to adjacent property owners before any decisions aze made by the <br />Division of Minerals and Geology on the Tanabe application? <br />• Exhibit G -Portions of the Phase 1 operation aze located in Zone A of the FEMA <br />floodplain for First Creek. The application does not address the regional impacts of <br />storm water flows and quality. Has a CLOMER or LOMER application been made to <br />FEMA? <br />• Exhibit M -Will gravel operations require a Fugitive Dust Permit? This issue is not <br />specifically addressed in the application. <br />• There aze two significant high-presswe gas mains in the vicinity of the proposed <br />mining operation. The application makes no mention of what precautions will be taken <br />to enswe the safety of the gas mains. <br />• The application does not address the use of explosives on this site. Will explosives be <br />used on this site? What measures will be taken to enswe the safe use of explosives? <br />• No meaningful outreach has been made to adjacent property owners to receive their <br />input or provide additional information. The proposed mining application could have <br />significant impacts on adjacent properties and a responsible applicant should make a <br />concerted effort to work with [heir neighbors. <br />In conclusion, this application is extremely concerning. Many health and safety issues aze <br />undressed and the application appears to be incomplete.
