9. Pneliminary Toxicity Investigation
The permittee will have 15 working days frtm the date of demonstration
of the pattern of toxicity to omelets a preliminary toxicity
i~igation and sukmtit (date of receipt) the results to the
Division, in writing. The "date of demonstration" shall be the date
the permitte becomes aware of the final test result that established
the pattern of toxicity. The preliminary toxicity investigation may
include, but is not limited to: additional chemical an3 biological
monitoring, p,~,,,; *+ation oP pretreatmrnt p records, e~i.ration
of disdrarge monitoring reports, evaluation of treatment processes and
r amical use, in•-pec~tian of materldl Stordge artd transfer areas to
determine if a spill may have oocttrred, aryl"similar prooedaas.
Zf the preliminary toxicity investigation identifies a probable toxicant
and/or a probable saurz of toxicity, the peimittee shall submit, as
part of its final report results, written notification to that effect to
the Division. within 3o days of c~tleting the preliminary toxicity
investigation, the permittee shall submit (date of receipt) for the
Division's approval a contzvl program to oarrtrol effluent toxicity, and
shall proceed to iaplement such plan within 7 days followirng receipt of
written approval from the Division.
If no probable explanation for toxicity is identified in the 15-day
preliminary toxicity investigation, a Phase I Teacicity laeduetion
~r Evaluation (TRE) is required. The permittee shall notify'tba Division,
as part of its final report, of its intent to proceed with the Phase I
TRE.
If toxicity disappears during the preliminary toxicity investigation,
the permittee shall submit written notification to that effect to the
Division. The Division rosy require the permittee to auxhrct accelerated
testirg to demon,trate the oorttirrmed absence of toxicity. It, after
completing any Divisiar directed aocelerate3 testing, no acute toxicity

10. Phase I THE
The Phase I THE performed by the perzaittee shall be in general
accordance with Methods for Toxicity Reduction Evaluations~Ph
Toxicity Characterization Procedures (September, 1988) n,titial+~7 by EPA,
or in accardance with procedures approved by the Division. If only one
species ~~TM+*+~**ated toxicity during accelerated testing, then that
species alone may be used in the Ptta.Se I TRE. The +ttee has 45 days
froth the submission (date of receipt) of the final report on the
preliminazy toxicity investigations to complete the Phase I ~ and
submit (date of receipt) a report to tine Division on the results of the
study.
