Pneliminary Toxicity Investigation <br />The permittee will have 15 working days frtm the date of demonstration <br />of the pattern of toxicity to omelets a preliminary toxicity <br />i~igation and sukmtit (date of receipt) the results to the <br />Division, in writing. The "date of demonstration" shall be the date <br />the permitte becomes aware of the final test result that established <br />the pattern of toxicity. The preliminary toxicity investigation may <br />include, but is not limited to: additional chemical an3 biological <br />monitoring, p,~,,,; *+ation oP pretreatmrnt p records, e~i.ration <br />of disdrarge monitoring reports, evaluation of treatment processes and <br />r amical use, in•-pec~tian of materldl Stordge artd transfer areas to <br />determine if a spill may have oocttrred, aryl"similar prooedaas. <br />Zf the preliminary toxicity investigation identifies a probable toxicant <br />and/or a probable saurz of toxicity, the peimittee shall submit, as <br />part of its final report results, written notification to that effect to <br />the Division. within 3o days of c~tleting the preliminary toxicity <br />investigation, the permittee shall submit (date of receipt) for the <br />Division's approval a contzvl program to oarrtrol effluent toxicity, and <br />shall proceed to iaplement such plan within 7 days followirng receipt of <br />written approval from the Division. <br />If no probable explanation for toxicity is identified in the 15-day <br />preliminary toxicity investigation, a Phase I Teacicity laeduetion <br />~r Evaluation (TRE) is required. The permittee shall notify'tba Division, <br />as part of its final report, of its intent to proceed with the Phase I <br />TRE. <br />If toxicity disappears during the preliminary toxicity investigation, <br />the permittee shall submit written notification to that effect to the <br />Division. The Division rosy require the permittee to auxhrct accelerated <br />testirg to demon,trate the oorttirrmed absence of toxicity. Phase I THE <br />The Phase I THE performed by the perzaittee shall be in general <br />accordance with Methods for Toxicity Reduction Evaluations~Ph <br />Toxicity Characterization Procedures (September, 1988) n,titial+~7 by EPA, <br />or in accardance with procedures approved by the Division. If only one <br />species ~~TM+*+~**ated toxicity during accelerated testing, then that <br />species alone may be used in the Ptta.Se I TRE. The +ttee has 45 days <br />froth the submission (date of receipt) of the final report on the <br />preliminazy toxicity investigations to complete the Phase I ~ and <br />submit (date of receipt) a report to tine Division on the results of the <br />study. <br />• <br />
