RULING
It is the ruling of the Referee that:
•
(1) The legel description of the point of diversion
of Hawke :rest Pipeline Ho. 2 (as previously decreed) should
be, and t.`.e same is hereby, corrected to the following:
Located at a point on the North bank
of the North Fork of the Cunnlson
River which is N 55.14' E 2210 feet
from the 4 cornet between Sections 10
and 15 of Township 13 South, Range 90
West of the 6eh P.N. in Gunnison
County, Colorado.

(2) an appropriation and application to beneficial

eondltlonally to Hawks Hest Pipeline No. 2 end anid Pipeline
is-hereby a=~ro•~ed and granted an absolute decren, for the
use and benefit of the parties lawfully entitled thereto, for

^sid Pipeline for mining and industrial purposes, with the
regaining c.f.a. continuing with its conditional decree
etatua beige conditioned upon the co-npletion of the structural
facilities as proposed and proof of the use of said 4 c.f.e.

month of F:sl•, 1930, and every four years thereafter until the
right as to this 1 c.f.s. is decreed fin:+l, the owner or
user thereo., if he desires to maintain the same, shall file
an application for quadrennial finding of reasonable diligence
with the Prater Clerk of this Court.
(3) ,ln appropriation and application to beneficial use

heretofore conditionally decreed to Hawks vest Pipeline No. 2,
which decree Sa hereby made absolute for the uae and benefit
Of the parties lawfully entitled thereto.
(4) The absolute decrees hereinabcve granted for 1 e.f.s.
and .05 c.`_.s. ate awarded a decree date of November 13, 1975,
(dais of filing the initial application for conditional decrees
herein) with an eppropsiation dote of July 22, 1975, and this
decree is subject to any and all rights with prior decrees.
(5) .1n alternate point of diversion for all or any part
o! tJ:e above described voter decreed, both absolute and
eonditionel, to Hawks Nest Pipeline Va. 2, is hereby approved
and granted for diversion either at the above described
point of di^eraion for Ha++ks Nest Pipeline No. 2 or, in the
alternati:•e, at the point of diversion for Hawks Nest Pipeline
No. l described as follows:

1348.82 feet from the 4 corner between
