Dace of filing: August 31, 1978 <br />:lo opposition has been filed. <br />FINDING OF FACT <br />RAWRS NEST PIPELINE NO. 2 has, a3 a source of eater <br />supply, the North Fork of the Gunnison River, a tributary to <br />the Gunnison River, in Gunnison County and in old S{a ter <br />District No. 40, and vas .q ranted a conditional decree in <br />tAia case No, W-2716 on July 29, 1976 for S e.f.s. for mining <br />and industrial use and .OS c.f.a. for domestic purposes, all <br />Kith an appropriation date of July 22, 1975. <br />• <br />?he point of diversion vas incorrectly described in that <br />decree and the correct point of diversion of tlawks Nest Pipr <br />line No. 2 is as follows: <br />Located at a point on the North bank of the <br />t:oz[h Fork of the Gunnison Piver which is <br />N SS•ld' E 2210 feet from the 4 corner <br />Eet•+een Sections 10 and 15 of Township 13 <br />6outh, Range 9C West of the 6th P.H. in <br />Gunnison County, Colorado. <br />The statxments in the verified application ere true and <br />correct. Applicant has aenzopriated, used and applied to <br />bene`ieial use chzough completed structural facilities, for <br />:aininq end industrial purpases,l c.l.s. of the aforesaid <br />5 e.f.s. heretofore conditicnally decreed, end also the entire <br />•OS c.l.s. for domes tie purposes heretofore conditionally <br />decreed, all with due diligence. <br />The point of diversion of Hawks Nest Pipeline No. 3 is <br />as stated in the application, to-wit: <br />A point on the North bank of the North Fork <br />of the Cunnsion River S 77.46'7" L9 1348.82 <br />feet from the 4 corner between Sections 11 <br />and 12, Township 13 South, Range 90 West of <br />the 6th P.M. in Gunnison County, Colorado. <br />• <br />There are no other decreed points of diversion between the <br />present point of diversion of }yn,!ts ~;,[ Pipeline No. 2 and the <br />poinc of diversion of Ilavks pest Pipeline No. 3 ns described <br />hercinabovc. Granting the eltcrnice point of diversion as re- <br />quested for alternate diversion at I(nvks Nest Fipolinc No. 3 <br />will not adversely affect:ar injure the eater ri:lhts or priorities <br />o! any other user. <br />
