<br />2. Discussion of Effluent Limitations
<br />a. BOD TSS total residual chlorine oil and tease and H: The Renzlations for E{lluent Limitations (Regulation No. 61)

<br />apply at the point offdischarge to state waters, Outfa11004. These limitations are the same as in the previous permit and
<br />are effective tmmefi:ately.
<br />b. Fecal Coli orm. 77te State's Procedure for Selection of Fecal coliform Limitations Permit Conditions establishes limits for
<br />eca co t orm: 6,000 organisms per m 3~y geometric mean an organisms per ml (7-day geometnc
<br />mean). ese limits are more stringent than the Zimtt based on water qquality Therefore, the limits at Outfah 007 will be
<br />set at the levels s eeified in the Procedure for Selection o/'Fecal coliform Limttanons Permit. Conditions. Because no
<br />other sources of fecal coliform are expected zn Pond MB-2X and ecal coliform treatment is not conducted in Pond MB-2R,
<br />no fecal coliform limits or monitoring will be required at Ou~ll 004 and instead fecal coliform limits are imposed at
<br />Outfal1007. .
<br />The fecal coliform limitations determined for Outfa11007 are equal to the previous permit limits and thus are imposed as
<br />permit limits effective immediately.
<br />c. ~ -This parameter is applicable to a1112 Outfalls from this facility that discharge directly to State waters and is limited
<br />y water quality standards as the water qualify standards o 6.5- 0 s.u. range are more stringent than those specified
<br />under the Re¢ttlations for Effluent Limitations. These limas are the same as those previously imposed and are effective
<br />tmmediate~

<br />Alternate Limitation Burden of ProofReauirements: In conformance with 40 CFR 434.63, the permittee has the burden of
<br />proo w ten see ang re to om tots s~ uspen3e~i skids (TSS), total iron, and/or settleable solids (sS) limitations. Discharges
<br />from Outfalls 011, 012, I3, and 017 are not eligible for this relief. Outfalls 004 and 016 may be eligible for relief from
<br />TSS, total iron, and SS, however, the maf'ority of the loading tom an discharge has to consist ofstorm runofffor the relief
<br />to be available. The permtaee will need to show that excee~nce of The applicable limitations was caused b pprecippitation
<br />and not mine water, through a coinpp~rison o(/'the loading from each source. The remaining permitted Outfa[[s (0(I5, 008,
<br />009, 014, 015 and 018) are eli ible for reliejfrom TSS, total iron and SS at all times since only surface runoff water
<br />discharges are authorized from t~ese outfalls.
