<br />B. Compliance With Terms and Conditions of Previous Permit
<br />1. Effluent Limitations: The data shown in the preceding tables indicate that the West Elk Mine facility has maintained
<br />comp i~IrTze previous permit with the exception of one WET Daphnia Ma,gqznta test failure at Outfall 017. The autfall
<br />returned to compliance followzng that test failure. Also, the flow limit was exceededat Outfa11007 three times.
<br />2. Other Permil Reauiremenu: The permittee has been in apparent compliance wish all other terms and conditions of the permit.
