A. COVERAGE UNDER THIS PERMIT

general permit or an individual permit is required, imtrad of coverage under this general permit)
b. Automatic Coverage: If the applicant does not receive a request for additional information or a notification
of denial from the Division dated within thirty days of the receipt of the application by the Division,
authorization to discharge in accordance with the conditions of this permit shall be deemed granted.
o. Individual Permit Required: If, after evaluation of the application (or additional information, such as the
SWMP), it is found that this general permit is not applicable to the operation, rhea the application will be
processed as one for m individual permit. The apphant will be notified of the Division's decision to deny
certification under this general permit. For an individual permit, additional information may be requested, and
180 days will be required to process the application and issue the permit. Temporary coverage under this
gweral permit will be allowed until the individual permit goes into effect.
d. General vs. Individual Permit Corsage: Any owner or operator authorved by this permit may request to
be excluded from the coverage of this permit by applying for en individual CDPS permit. The owner or
operator shall submit m individual application to the Division, with reasons supporting the rogues[.
e. Permit CertiFirations: The individual certification prepared for each applicant will indicate whether Part I.B
of the permit which moat be followed by that applicant. PaR I.C must be followed by all permittees unless
exempted as outlined in Section III.C of the Ratiopale. (In the absence of such indication from the Division,
the permittee will be responsible for determining and then complying with the applicable sections in Part I J
in addition, all peimittees will be required to comply with Part I, subparts A, D, E and F, and all of
Part II of the permit.
6. Permit Expiration Date
Authorization to discharge under this general permit shall commence on October 1, 1992, end shall expire on
September 30, 1997. The Divisive must evaluate and reissue this general permit pace every five yeara, and must
also recertify the applicant's authority to discharge under the general permit at such time. Therefore, any permittee
desiring continued coverage order the general permit must reapply by March 31, 1997. The Division will determine
if the applicant may continue to operate under the terms of the general permit.
An individual permit will be required for any facility not reauthorized to discharge under the reissued general permit.
For facilities wishing to terminate authorization under the new permit, provisions of Part II.B.S.d will be applicable.
Inactivation of Certification
The permittee may request inactivative of thetr certification under this permit, once the site has been fully released
from their reclamation bved requiremwta by the Colorado Division of Mining end Geology (CDMG). See Pert
II.B.S.d of the permit.
B. EFFLUENT LIMITATIONS AND CONDITIONS -PROCESS WATER DISCHARGE
(Ibis section (I.B) only applies to facilities with a discharge of process water)
1. General Limitations
a. There shall be no discharge of sanitary waste waters from toilets or related facilities.
b. There shall be ao discharge of floating solids or visible foam in other then trace amomte.
