6. Rule 3.19(4) requires the Operator to rehandle stockpiled topsoil as little as possible until replacement on the <br />regraded, disturbed area. Relocations of topsoil stockpiles on the affected land require Board or Office approval. <br />Please depict the location(s) of the topsoil stockpile(s) on the map so that the Division may monitor handling of the <br />topsoil during the operation. <br />Rule 6.4.4 Exhibit D- Minim Plan <br />Section (a) of the Mining Plan requires the Operator/Applicant to supply a description of the method(s) of mining <br />to be etnployed in each stage of the operation as related to any surface disturbance on affected lands. The applicant <br />states that this operation will excavate down to approximately 10 feet and will not expose groundwater. A nearby <br />pit operated by Park County does contain exposed groundwater and the exposed groundwater appears to be less <br />than ] 0 feet below the ground surface. Please identify the depth to water at the site and be aware that in order not <br />to expose groundwater, the operator must remain at least two feat above the existing depth to water at the site. (If <br />ground water is exposed, the Office of the State Engineer will need to be contacted to address water rights issues. <br />If the Operator decides to dewater the operation, the Water Quality Control Division should be contacted for <br />possible discharge permits. Additionally, any such changes to the mining plan would require a revision to the <br />permit) <br />8. Section (a) (d) of the Mining Plan requires the Operator/Applicant to describe the size of area(s) to be worked at <br />any one time. The application states that the Operator will limit the mining disturbance to ten acres. Please be <br />aware that inclusion of this statement limits the mining disturbance in the permit to no more than ten acres at <br />any given time. The submitted map indicates that two of the phases exceed ten acres. If the ten-acre Limit is not <br />suitable for the Operator, please specify if more than ten acres of mining disturbance will occur at the site at <br />anytime during the life of the permit. <br />9. Section (f) of the Mining Plan requires the Operator/Applicant to present (i) the nature, depth and thickness of the <br />deposit to be mined and the thickness and type of overburden to be removed, and (ii) the nature of the stratum <br />immediately beneath the material to be mined in sedimentary deposits. Please supply this information. <br />Rule 6.4.7 Exhibit G-Water Information <br />10. Rule 3.1.6 (1) states that disturbances to the prevailing hydrologic balance of the affected land and of the <br />sttrrounding area and to the quantity and quality of water in surface and groundwater systems both during and after <br />the mining operation and during reclamation shall be minimized. The applicant states that a processing plant and <br />concrete plant will be located on a portion of site. Please describe how the facilities will be managed to ensure that <br />impacts to groundwater and surface water quantity and quality will be minimized. <br />11. Also with regard to Rule 3.1.6 (1), the site of proposed mining is located near the Middle Fork of the South <br />Platte River. Some or all of the activity proposed in this application may be located within the river's <br />floodplain. Please supply data that will identify whether mining activity at the site falls within the floodplain <br />of the river. If the operation does fall within the floodplain of the river, please address potential impacts to <br />immediately upstream and downstream properties resulting from a 100 year flood event, i.e. will the mining <br />activities increase the potential to offsite impacts during a flood? If so, how will such impacts be minimized <br />and/or mitigated? <br />12. Section (3) of Water Information requires the Applicant/Operator to provide an estimate of the project water <br />requirements including flow rates and atmual volumes for development, mining and reclamation phases of the <br />project. Please supply the above information. <br />
