Cattany <br />Division Direcor <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Allen Pit 112 (c) Permit Application, File No. M-2005-080. The <br />decision date for this permit has been extended to June 1, 2006 due to objections received. In order to meet this <br />deadline, a hearing to determine whether the application shall be approved or denied by the Mined Land Reclamation <br />Board (Board) must be scheduled for the May 10, 2006 meeting of the Board. The Division of Minerals and Geology <br />(Division) is required to make a recommendation for approval, approval with conditions, or denial by no later than <br />April 18, 2006 in order to allow adequate time for notifications and scheduling of apre-hearing conference to address <br />the application objections. Therefore, your response to the following adequacy review concerns should be submitted to <br />the Division as soon as possible. <br />Rule 1.65 (2), requires proof of notice to all owners of record of surface ]ands, and easement holders that are on <br />the affected lazed and within 200 feet of the boundary of the affected land. Please supply these proofs of notice. <br />Additionally, if utilities are located within 200 feet of the boundary, these entities must also receive notice. Please <br />also supply proof of notice to these entities. <br />2. Rule 6.2.1(2) requires that maps be prepared and signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not sighed. Please submit the proper, signed <br />maps to the Division. <br />Rule 6.4.3 Exhibit C-Pre Minims and Mine Plan Man(sl of Affected Land <br />3. Section (a) of the Pre-Mining and Mine Plan Map(s) of Affected Land requires the Applicant to portray ale <br />adjoining surface owners of record. The adjacent surface owners west of Hwy 9 are not identifted on the map. <br />Please supply a map that reflects this information. <br />4. Section (b) of the Pre-Mining and Mine Ptan Map(s) of Affected Land requires the Applicant to identify the name <br />and location of all creeks, roads, buildings, oil and gas wells and lines, and power and cortununication lines on the <br />area of affected land and within two hundred (200) feet of all boundaries of such area. No utilities are identified on <br />the submitted map. Please state if no utilities are located within this radius, or, if utilities exist in this area, please <br />include them on the map. <br />5. Section (g) of the Prewlining and Mine Plan Map(s) of Affected Laud requires the Applicant to show the owner's <br />name, type of stmctures, and location of al] significant, valuable, and permanent man-made structures contained on <br />the area of affected land and within two hundred (200) feed if the affected land. Exhibit S indicates the presence of <br />a fence within this radios.
