Rule 6.4.12 Exhibit L -Reclamation Costs <br />13. The Division will estimate the cost to reclaim the site once the applicant addresses the adequacy issues raised <br />throughout the review process. The Division will estimate a cost to reclaim the site based on the information <br />submitted in the application and responses to adequacy reviews. <br />Rule 6.4.12 Exhibit N -Source of Leeal Right to Enter <br />14. This Rule requires the Operator/Applicant to provide the source of the Operator/Applicant's legal right to enter and <br />initiate a miuing operation on the affected land. Aland title for the site was supplied with the application <br />indicating that the Operator is the landowner. No reference in the documentation, however, is made to the mineral <br />rights. Please supply documentation as to the ownership and defined mineral rights for the property. <br />Because objections were filed for this Permit, this matter must be set for a hearing before the Board. The tentative date <br />for the hearing is May 10, 2006. The Division will need to make a recommendation by April 18, 2006. Please be <br />advised that the Allen Drilling and Excavating Co., Inc. 112(c) Permit Application may be deemed inadequate, and the <br />application may be denied on May 10, 2006 unless the above mentioned adequacy review items are addressed to the <br />satisfaction of the Division. Responses to these adequacy concerns must be received by the Division to allow adequate <br />tithe For review prior to the recommendation date, or no later than April 14, 2006. If you feel more time is needed to <br />complete your reply, the Division can grant an extension to the recommendation date, and therefore the decision date. <br />This will be done upon receipt of a written waiver of your right to a decision by June 1, 2006 and request for additional <br />time. This must be received no later than May 9, 2006.
