~.,
,.
• , ~. I' ,. .
.

15. The sediment pond plan has been changed to add one pond in each mining cell.
Each pond will acceptdewatering effluent pumped from the"adjacent mining cell.
• Above ground piping will be used to move waterfrom the pump to the sediment
ponds. O,verflow.pipes will discharge to the Big Thompson River. The pond
locations, pond details and piping have been added to Exhibit C-2. -Since the
sedimeiit.ponds are located within the mining area; reclamation will occur as part
• of preJiously.described mining cell reclamation. ,
16. Exhibit C-2 has been ecJ'ited to include the location of the dewatering trenches,
size of trehches'and discharge points.
' 17. These issues have been resolved by locating multiple sediment~{ionds adjacent
' to active mining`cells. "
•18. It was previously thought that this ditch was a"drainage ditch, which is incorrect.
The existing ditch that runs adjacent to the border between CeIIs C and D is
owried by the appticarit's Lessor (McWhinney Enterprises) and has beeri used
historically"as-ari irrigation ditch to route water from a groundwater seep that-
' originates just north of the proposed pits to the fields below, which are proposed
for mining. The,mine plan has been revised so as not route this water around the
pit,-but rather, allow the water to drain into the pit, where it will be pumped.
Exhibit D,lias beeri edited to include this change...
Rule"6.4.5 Exhibit E -Reclamation Plan '
~' 19. The water table'occurs'at a depth of approximately 10-12 ff below ground surface
. in Cells A'B and 6=10 ft below ground in Cells C-D. Exhibit C-1 .has been edited
to include pre-mining water table contours. '
'~ 20. Exhibit E'has been edited to include a section on Clay Liner Construction: Liner
dimensions have been added 4o Exhibit F- Sheet 2.
21. Exhibit F- Sheet 2 has been edited to extend the liner to 3 ft above water table
elevations. The water table based on observation well data has been added to
' the cross section as well. '
~' 22. Cell D will be planted with native grasses and used for grazing. The property has
a decreed seepage water right"for 1.06 cfs, which has historically been used to
irrigate the fields.' This.water. right can be used for reclamation and post mining
land use.. "
~~ 23. This'ditch, has.been removed from the plan. Instead, a pipe has been placed to
.route the groundwater seep to the river (when not used for irrigation). Exhibit F
~, has been. updated•to show pipe .location and details.
,~ 24. The haul rgad, cbnnecting Cells A-B to Cells C-D will be left as an improvement to
the existing road between these two areas of the property. , A small portion of.the
'. " haul road soutb,of Cell D (the portion not mined through) will be fopsoiled and
revegetated in tfie, same manner as the rest of the site.
25. This wetland was determined to be anon-jurisdictional wetland by the Army
-Corps of'Engineers (see Attachment M=1 ), however Larimer County is requiring
~.,
