All releases of replacement water must be sufficient to cover depletions and be <br />made under_the direction and/or approval of the Water Commissioner. The _ _ <br />replacement may be aggregated to maximize beneficial use. The Water <br />Commissioner and/or Division Engineer shall determine the rate and timing of an <br />aggregated release. <br />4. The amount and location of the dry-up of the irrigated acreage associated with the <br />use of the Fulton Ditch water must be documented and provided to the Water <br />Commissioner and the Division Engineer prior to October 31, 2000. A map and <br />legal description will be necessary. <br />5. The total surface area of the ground water exposed after December 31, 1980, <br />must not exceed 69.1 acres, and uses must not exceed 183.53 acre-feet of <br />evaporative losses. <br />6. A plan to maintain historic irrigation return flows in time, quantity and location <br />associated with replacement sources is required in accordance with the general <br />criteria. Additionally, the maintenance of historic return flows can be considered <br />when determining replacement of proposed depletions from a gravel mining <br />operation. A plan must be in place to maintain historic return flows during times of <br />a senior downstream call even though the senior call may not have existed at all <br />times of the year. <br />In accordance with amendments to §25-8-202(7), C.R.S., and Senate Bill 89-181 <br />Rules and Regulations adopted on February 4, 1992, the State Engineer shall <br />determine if the substitute supply is of a quality to meet requirements of use to <br />which the senior appropriation receiving the substituted supply has normally been <br />put. As such, water quality data or analysis may be requested at any time to <br />determine if the requirements of use of the senior appropriator are met. <br />8. Approval of this plan is for the purpose as stated herein. Any additional uses for <br />which the water may be used must first be approved by this office. <br />9. The replacement water which is the subject of this plan cannot be sold or leased to <br />any other entity. As a condition of subsequent renewals of this substitute water <br />supply plan, the replacement water must be appurtenant to this site until a plan for <br />augmentation is obtained. All documents which make the replacement water <br />appurtenant to this site should be recorded with the county clerk and must be <br />submitted to this office. <br />9. This substitute water supply plan may be revoked or modified at any time should it <br />be determined that injury to other vested water rights has or will occur as a result <br />of this plan. <br />10. Adequate accounting of daily diversion and replacement must be provided to the <br />Division Engineer in Greeley and Water Commissioner (Robert Stahl, 9378 WCR <br />25, Ft. Lupton, CO, 80621, (303) 857-0742) on a monthly basis or other interval <br />acceptable to both of them on a form approved by them. The daily measurements <br />must be recorded manually or by an adequate recording device. <br />.~ <br />
