Simpson, P.E. <br />State Engineer <br />We have received your letter of February 22, 2000, requesting renewal and amendment of <br />the above referenced substitute water supply plan. The mining operation has been completed <br />and the final size of the resulting lake is 69.1 acres. <br />The anticipated net depletion for this plan is 183.53 acre-feet per year for the 69.1 acres of <br />lake surface exposed after December 31, 1980. According to information submitted, no portion of <br />the lake surface within the reclamation permit boundary was exposed prior to January 1, 1981. <br />The proposed source of replacement water is 50 shares of Fulton Ditch (87.8 acre-feet) <br />historically used at the site. A lease of 18 acre-feet from Consolidated Mutual Water Company <br />will replace the remaining summer depletions. The winter depletions will be replaced by 54.2 <br />acre-feet of reusable effluent from the City of Greeley. The monthly depletions and replacement <br />requirement are found on the attached tables. Please note in Table No. 2 that additional <br />replacements are required. Although there may not currently be a call on the river, additional <br />water must be obtained and available for release during the January through March period. <br />This substitute water supply plan is hereby approved pursuant to Section 37-80-120, <br />C.R.S., subject to the following conditions: <br />A well permit must be obtained for the gravel pit's current size in accordance with §37- <br />90-137(2) and (11), C.R.S. The provisions of Colorado Revised Statute 37-90-137(2) <br />prohibits the issuance of a permit for a well to be located within 600 feet of any existing <br />well, unless the State Engineer finds that circumstances so warrant after a hearing held <br />in accordance with the procedural rules in 2CCR402-5. This hearing may be waived if <br />you are able to obtain statements from the owners of all wells within 600 feet, verifying <br />that they have no objection to your use of the proposed well. <br />2. The applicant must submit an application for a permanent plan for augmentation <br />with the Water Court by August 1, 2001. Renewal of this plan may depend on <br />progress made toward a permanent plan. Approval of this plan does not imply <br />approval by this office of any related litigation. <br />
