We have received your letter of February 22, 2000, requesting renewal and amendment of
the above referenced substitute water supply plan. The mining operation has been completed
and the final size of the resulting lake is 69.1 acres.
The anticipated net depletion for this plan is 183.53 acre-feet per year for the 69.1 acres of
lake surface exposed after December 31, 1980. According to information submitted, no portion of
the lake surface within the reclamation permit boundary was exposed prior to January 1, 1981.
The proposed source of replacement water is 50 shares of Fulton Ditch (87.8 acre-feet)
historically used at the site. A lease of 18 acre-feet from Consolidated Mutual Water Company
will replace the remaining summer depletions. The winter depletions will be replaced by 54.2
acre-feet of reusable effluent from the City of Greeley. The monthly depletions and replacement
requirement are found on the attached tables. Please note in Table No. 2 that additional
replacements are required. Although there may not currently be a call on the river, additional
water must be obtained and available for release during the January through March period.
This substitute water supply plan is hereby approved pursuant to Section 37-80-120,
C.R.S., subject to the following conditions:
A well permit must be obtained for the gravel pit's current size in accordance with §37-
90-137(2) and (11), C.R.S. The provisions of Colorado Revised Statute 37-90-137(2)
prohibits the issuance of a permit for a well to be located within 600 feet of any existing
well, unless the State Engineer finds that circumstances so warrant after a hearing held
in accordance with the procedural rules in 2CCR402-5. This hearing may be waived if
you are able to obtain statements from the owners of all wells within 600 feet, verifying
that they have no objection to your use of the proposed well.
2. The applicant must submit an application for a permanent plan for augmentation
with the Water Court by August 1, 2001. Renewal of this plan may depend on
progress made toward a permanent plan. Approval of this plan does not imply
approval by this office of any related litigation.
