1 <br /> 1 <br /> sell the Property to another person, firm or corporation. Such sale to a third party shall be subject <br /> to this Lease and all the terms, covenants and conditions of this Lease. <br /> ' 12. GJP shall pay all charges for electricity, gas, water and utilities furnished or supplied <br /> to or on any part of the Property. <br /> ' 13. GJP shall conduct its mining operations under this Lease in a good and minerlike <br /> manner and shall conduct all operations in compliance with all applicable laws and regulations of <br /> any governmental entity having jurisdiction over such operations or the Property including without <br /> ' limitation all laws and regulations pertaining to mine safety and health, and environmental and <br /> operational laws and regulations regulating waste and waste water production, removal, storage, <br /> transportation and disposal. <br /> ' A. GJP shall pay before they become delinquent all costs and expenses of its <br /> operations on the Property, together with all governmental fees, charges and taxes upon <br /> ' GJP's operations conducted on the Property under this Lease. <br /> ' B. GJP shall keep the Property free of liens for labor performed or materials or <br /> merchandise furnished for use on the Property under this Lease. <br /> ' C. GJP shall permit District to post, and shall keep posted upon the Property, <br /> notices of nonliability for labor performed or materials or merchandise fumished. <br /> ' D. GJP shall maintain the access road described in Paragraph 2, any road on the <br /> Property utilized by GJP subject to realignment rights under Paragraph 1 and the remainder <br /> of the Property not excavated by GJP's operations in no worse condition than when the same <br /> ' were made available to GJP, except that GJP shall not be responsible for maintenance or <br /> repair of any road due to any acts of God or any act or omission by anyone other than GJP. <br /> GJP shall construct and maintain any fences on the Property required by governmental <br /> ' requirements applicable to GJP's operations. These fences shall be removed by GJP at its <br /> expense upon termination of this Lease, if requested by District in writing within 60 days <br /> ' after termination. <br /> E. At all times during the Term, GJP at its expense shall maintain the following <br /> ' insurance: <br /> (i) Workers Compensation insurance (including occupational disease <br /> ' insurance) as required by law; <br /> (ii) Commercial general liability insurance covering bodily injury and <br /> ' property damage with combined single limit per occurrence coverage not less than <br /> $1,000,000 for each occurrence and $2,000,000 general aggregate and deductible of <br /> not more than ten thousand dollars ($10,000), plus umbrella coverage from excess <br /> ' r:\vp\:h9H\O4Mdms\GRAVLES.4CWD -9- September 20. 1996 <br /> 1 <br />
