~ ~ `/ <br />C-46517 <br />Exhibit B: Special Stipulations <br />For the purpose of these stipulations, the Authorized Officer is the San <br />Juan Resource Area Manager, Federal Building, 701 Camino del Rio, Durango, <br />Colorado 81301 {303) 247-9082. <br />1. The Holder will notify the Authorized Officer five (5) days prior to <br />commencement of any surface-disturbing maintenance or upgrading <br />activities. <br />2. The Holder shall contact the grazing permittee for BLM Allotment No. <br />8902 (currently Mr. Emmett Elizondo, P.O. Box 507, Fruita, CO 81521) <br />prior to June 10th of each year this permit is in effect. The Holder <br />shall present a schedule or general information for any anticipated <br />road closures during the summer season and afford the permittee :!n <br />opportunity to comment or propose modifications to this schedule, if <br />conflicts with grazing use are anticipated. In the event the Holder <br />and the permittee cannot resolve such conflicts, the Holder shall <br />contact the Authorized Officer, BLM. <br />3. The Holder shall comply with all the conditions of the San Juan <br />County Commissioners with regard to public safety on County Road 25, <br />including avalanche control measures, blasting procedures, and :iny <br />signing, flagging, or closure of the road for public safety. <br />4. The Holder shall protect all survey monuments, witness corners, <br />reference monuments, and bearing trees within this right-of-way <br />against disturbance during construction, operation, maintenance, and <br />termination of the facilities authorized herein. If any monuments, <br />corners, or accessories are destroyed, obliterated, or damaged during <br />construction, operation or maintenance, the Holder shall secure the <br />services of a Registered Land Surveyor to restore the disturbei <br />monuments, corners, or accessories, at the same location, using <br />surveying procedures found in the Manual of Surveying Instructions <br />for the Survev of the Public Lands of the United States. The Holder <br />shall ensure that the Registered Land Surveyor properly records the <br />survey in compliance with Colorado Revised Statutes 38-53-101 through <br />38-53-112 (1973) and shall send a copy to the Authorized Offi~:er. <br />5. Natural vegetation shall be cleared or trimmed only xhen necessary to <br />provide suitable access. <br />6. Prior to R/W construction, the Holder shall make arrangements with <br />the Authorized Officer to purchase and dispose of all trees requiring <br />removal. <br />
