An attachment to the NOV describes specific areas cited in the NOV in <br />• greater detail and it also includes a map showing the locations of <br />transects taken in the field and from topographic maps by the MLR <br />inspector for the purpose of measuring and comparing slope gradients. <br />Actions required of CYCC by MLR to abate the violation are described <br />as follows: <br />Implement measures necessary to effect compliance with <br />the approved permit and achieve approximate original <br />contour in area 9/10, area 31, area 41, area 51, area <br />51E, and area 7 by November 8, 1986. <br />The specific violations listed in the NOV can be grouped into two <br />general catagories. First, a Swale-like feature in the vicinity of the <br />final pit in areas 9/10, 7, and 31 is identified as significantly <br />different from the approved post-mining topography. Upper slopes of the <br />• Swale are cited as oversteepened relative to approved slope gradients <br />and disruption of the drainage pattern by flatter slopes and isolated <br />mounds on the lower side of the Swale is cited as a significant <br />deviation from the approved topography. The second category of <br />violations involves isolated locations, mostly along the lower areas of <br />the mine where drainage way or channel gradients have been oversteepened <br />relative to the approved topography. The NOV states that in most of <br />these locations downcutting has occurred and it has been difficult to <br />stabilize the drainage way. In addition to oversteepened drainages two <br />locations are cited where drainages have been constructed where there <br />was none on the approved topographic map. <br /> <br />2 <br />
