1. INTRODUCTION <br />The Colorado Yampa Coal Company (CYCC) was issued a notice of <br />violation (NOV) on August 8, 1986 for failure to regrade final slopes to <br />approximate original contour (AOC). Water Engineering and Technology, <br />Inc. has prepared this report to provide CYCC with information for <br />negotiation of a solution to the NOV which was issued by the Colorado <br />Mined Land Reclamation (MLR) Division, Department of Natural Resources. <br />The deadline for abatement of the violation is 90 days after issuance of <br />the violation, or November 8, 1986. <br />1.1. Statement of the Problem <br />Colorado Yampa Coal Company was issued NOV No. C-86-061 which states <br />the nature of the violation as follows: <br />• Failure to conduct backfilling and grading in <br />compliance with approved permit and failure to return <br />all areas affected by surface coal mining operations <br />to their approximate original contour. Failure to <br />insure that final graded slopes do not exceed in grade <br />slope gradients approved by the Division and failure <br />to insure that final graded slopes approximate the <br />general nature of the pre-mining topography. <br />Specific regulations cited are 4.14.1(2)(a) and 4.14.2(1). A <br />modification to the NOV was submitted on August 15, 1986 to add an <br />additional area of the mine to the NOV. With the addition of this new <br />area the portion of the mine to which the notice applies is described as <br />follows: <br />Final pit swales in area 9/10, area 31, and area 7, <br />oversteepened hillslopes in area 9/10, area 31, and <br />area 7, and oversteepened valley gradients in area 41, <br />area 51, area S1E, area 31, area 9/10, and area 7. <br />1 <br />
