3. Written notice of said hearing shall be sent by registered mail at least <br />fourteen (14) days prior to the hearing date to the last ]mown address <br />of the owners of property adjacent to the property in question. <br />4. In ruling upon any sign variance request, the Boazd shall include a <br />written finding in its minutes as part of the record Said finding shall <br />set forth the facts and circumstances upon which the Board has relied <br />in malting its ruling. <br />g, Variance Review Standazds. Variance from the provisions of this Section <br />shall for the minimum amount necessary to overcome the unique condition <br />and shall be granted only on evidence that the request is consistent with <br />the following review standards: <br />1. No variance will be approved unless it is found that there aze <br />hardships, difficulties or exceptional conditions that render the strict <br />application of the requirements of this Section unreasonable. The <br />alleged hazdship, difficulty or exceptional condition may not have <br />been created by an intentional action of any person presently having <br />an interest in the property. <br />2. The application must demonstrate that the proposed signage cannot <br />be reasonably installed as provided in this Section due to unique <br />physical characteristics of the property, its sua~oundings and/or the <br />unique nature of the sign itself. <br />That special conditions exist which are exceptional, unique or <br />peculiaz to the land or building involved and are generally not found <br />to exist or apply to other property within the same zone district or <br />vicinity. <br />4. That any request to increase the size or decrease the setback distance <br />bas sufficiently demonstrated that without variance approval the <br />essential informative content of the sign would not be readable or <br />legible without visual aid by a person of normal acuity when viewed <br />from the main-traveled way. <br />The applicant has sufficiently demonstrated that the proposed <br />signage would be compatible with the surroundings and not <br />detrimental to the visual character of the area. <br />6. The strict application of the sign code regulations would deprive the <br />property or business owner of the reasonable use of the property. <br />Gilpin County Zoning Regulations 57 <br />
