2. All parties in interest shall be contacted and an appeal hearing shall be <br />scheduled at the earliest regulazly scheduled Boazd meeting in which <br />said parties would be available or within fifteen (1ST days ofwhen the <br />appeal was filed, whichever occius fnrst. All parties in merest shaIl <br />then be re-contacted and informed of the time, date and place of the <br />meeting. <br />3. No new evidence maybe submitted at the meeting unless a majority <br />vote determines that such evidence could not be reasonably presented <br />at the tune the appeal was &led or that such evidence is appropriate and <br />necessary to refute or correct erroneous or misleading evidence which <br />may have improperly affected the County Planner's decision <br />4. If there is substantial evidence to support the decision of the County <br />Planner, such decision shall be affirmed by a majority vote. Otherwise, <br />the Board may reverse the decision or modify, reject or add to any <br />conditions or findings established by the County Planner with respect <br />to the matter under appeal. <br />5. This action may not be further appealed and may only be subject to <br />review by the courts pursuant to law. The refusal of the applicant to <br />comply with the terms and conditions of the final decision shall be <br />deemed a violation of said decision and shall be subject to the <br />applicable penalty gmvisions established within this Section or may <br />render the appeal decision null and void. <br />D. Non Administrative Si¢n Variances. <br />The Board shall review sign permit applications involving a request <br />for variance from the terms of this Section in those instances where <br />the variance will exceed, by more than ten (10) percent, the maximum <br />allowable limit(s) specified within this Section or whenever the <br />County Planner refers an ajm;,,i.~tive variance request directly to <br />the Boazd for final determination. <br />2. A public hearing shall be held prior to consideration of the variance <br />application. Following receipt of the completed application and fee, as <br />specified within the Gilpin County Fee Schedule, to cover the cost of <br />advertising and processing the application, a notice of said hearing <br />shall be published in a newspaper of general simulation within the <br />County at least fourteen (14) days prior to the meeting date. <br />Gilpin Coun9y Zoning Regulations 56 <br />
